Hanoi-Vietnam: From July 01, 2019, a series of new policies regarding officials and public employees officially come into force

Salaries and allowances of officials and public employees

Decree 38/2019/ND-CP stipulates the statutory pay rate for officials, public employees and the armed forces

According to the content of this Decree, from July 1, 2019, the statutory pay rate of officials and public employees will increase from 1,390,000 VND/month to 1,490,000 VND/month (an increase of 100,000 VND/month)

Decree 44/2019/ND-CP on adjustment of pensions, social insurance allowances and monthly benefits

According to this Decree, with the increase in the statutory pay rate to 1,490,000 VND/month, the pension, social insurance allowance and monthly allowance also increased by 7.19% from the time of the increase in the statutory pay rate.

Circular 04/2019/TT-BNV on guiding the implementation of statutory pay rate and allowances for beneficiaries of salaries and allowances in public agencies, organizations, and public service providers of the CPV, State, socio-political organizations and associations

From 01/7/2019, the method of calculating salaries and allowances for employees and employees in the CPV, State, socio-political organizations, and VSNCL agencies is carried out according to the following formula:

- Salary = 1,490,000 VND/month x Current salary coefficient.

- Allowance level:

+ Allowances calculated according to the statutory pay rate = 1,490,000 VND/month x Current allowance coefficient.

+ Allowances calculated as % of the current salary plus leader allowance and extra-seniority allowance (if any):

Allowance level = [salary + leader allowance (if any) + extra-seniority allowance (if any)] X Allowance percentage.

+ The allowances prescribed in a specific amount shall remain the same according to current regulations.

- Amount of reserved difference coefficient (if any) = 1,490,000 VND/month x Reserve difference coefficient.

Circular 79/2019/TT-BQP guiding the implementation of the statutory pay rate for those who are receiving salaries or military rank allowances from the state budget in agencies and units under the Ministry of National Defense

According to this Circular, from July 1, 2019, the new statutory pay rate of 1,490,000 VND/month will be applied to the following subjects:

- Officers, professional soldiers, non-commissioned officers, soldiers, defense workers, defense public employees and defense officials;

- Cipher officers who are not military personnel or People's Police; persons doing other work in cipher organizations; cipher students;

- Persons working under the regime of employment contracts with salaries according to Decree 204/2004/ND-CP.

At the same time, the Circular also stipulates the calculation of salaries, military rank allowances, reserved difference coefficients, and allowances and subsidies implemented from July 1, 2019 of the above subjects.

Circular 03/2019/TT-BNV amending and supplementing a number of regulations on recruitment of officials and public employees, raising ranks of officials, promoting professional titles of public employees, and implementing the contract regime for some types of jobs in state administrative agencies and public service providers

Declaration of assets and incomes of officials

Law on Anti-Corruption 2018

According to the new provisions in this Law from July 1, 2019, all officials must declare assets, instead of just a few groups of subjects as before. Specifically, officials must declare their assets, incomes and fluctuations in their assets and incomes, those of their spouses and minor children honestly. The current Law only stipulates this obligation for a number of officials in communes, wards and townships, persons in charge of managing the State's budget and assets or directly contacting and settling affairs of agencies, organizations, units and individuals.

According to this Law, from July 11, 2019, the time limit for citizens to perform the obligation to participate in the people's police will be reduced from 36 months (current regulations) to 24 months. At the same time, from July 1, 2019, a series of regimes will be changed for officers and non-commissioned officers who change branches and demobilize

Decree 49/2019/ND-CP detailing and measures to implement a number of articles of the Law on People's Public Security

According to this Decree, from July 1, 2019, there will be a series of new policies for the police force. Specifically: adding more cases of police being discharged to the locality; changing the interests of demobilized officers and non-commissioned officers; detailing regimes for officers and non-commissioned officers who change branches; changing regimes and policies for officers and non-commissioned officers of the Armed Forces on sick soldier leave; and detailing the salary table of police workers.
