On September 30, 2024, the Government of Vietnam issued Decree 119/2024/ND-CP stipulating electronic payment for road traffic in Vietnam.

According to Article 20 of Decree 119/2024/ND-CP, the payment for fees, charges, prices related to traffic activities of vehicles via traffic account in Vietnam is regulated as follows:

- Management units for toll collection use a single-lane method with barriers or mobile device systems to read terminal card information for payment of required fees, prices, and other service charges.

- Transaction Processing:

(1) In the case where the Road Traffic Payment Service Provider determines the cost:

When the vehicle enters the recognition area of the equipment system installed at the toll point, the equipment system will read the information and send the transaction data to the Operation System and Data Center of the Road Traffic Payment Service Provider to carry out the electronic road traffic payment and send feedback to the equipment system at the toll point to conclude the transaction.

(2) In the case where the equipment system at the toll point determines the cost:

When the vehicle enters the recognition area of the equipment system installed at the toll point, the equipment system will read the information to calculate the fees, prices, and other service charges required and send the transaction data to the system of the Road Traffic Payment Service Provider to conduct the electronic road traffic payment; the service provider will send the processed transaction data back to the equipment system at the toll point to conclude the transaction.

(3) The content of information exchanges and electronic road traffic transaction processing must be conducted according to standards, technical specifications for toll points, and other related technical standards.

(4) After completing the transaction, the Road Traffic Payment Service Provider and the toll operation unit will synchronize the electronic road traffic payment transaction data into the Electronic Road Traffic Payment Database System.

(5) The toll management unit decides on the handling of payments according to the provisions mentioned in (1) or (2) above.

- The toll management unit selects the appropriate payment method for each fee, price, or service charge.

Regulations on opening traffic accounts in Vietnam from October 1, 2024

- The provider of the road use payment service shall open traffic accounts and provide access accounts for the electronic road traffic payment application to vehicle owners at the first attachment of the terminal card.

- At the time of executing the electronic road traffic payment transaction, the traffic account can only be associated with one non-cash payment method in accordance with banking laws for electronic road traffic payment. The non-cash payment instrument is provided by the non-cash payment provider organization through a service contract with the electronic road traffic payment service provider.

- Each traffic account can be used to pay for many vehicles owned by the vehicle owner; each vehicle can only receive payments from one traffic account.

- Entities eligible to open traffic accounts include:

+ Individual vehicle owners with full civil conduct capacity as prescribed by law;

+ Organizations legally established and operating according to legal provisions.

- The documentation for opening a traffic account must ensure that the full traffic account information is provided as stipulated in the Annex attached to Decree 119/2024/ND-CP.

- Verification of information for the vehicle owner opening a traffic account:

+ Vehicle owners must provide and update accurately and fully all information in the traffic account opening documentation to the road use payment service provider and bear responsibility for the truthfulness of the provided information.

+ The service provider must verify, cross-check; ascertain the identification information for organizational vehicle owners and authenticate personal vehicle owners through the national database on population.

- Traffic account information must be synchronized by the electronic road traffic payment service provider after opening or whenever there are information changes with the Road Traffic Electronic Payment Database Management System.

The payment instrument information must be synchronized by the road traffic payment service provider after connecting or whenever there are changes or additions with the Road Traffic Electronic Payment Database Management System. These updates must occur within 6 hours of the changes being updated on the Operating System and Data Center of the electronic road traffic payment service provider.

- The service provider of road use payment must publicly disclose the terms of registration for opening and using traffic accounts to vehicle owners; the process and procedures for receiving and handling traffic account opening documentation;

The method and location for signing traffic account opening and usage contracts for each entity must match their condition and provision capability, while ensuring compliance with legal regulations and bearing responsibility for the accuracy, coherence, and completeness of the traffic account opening and usage documentation and contract.

- In the event of changes to the information in the traffic account opening documentation, the traffic account owner must inform the road use payment service provider for updating in the Road Traffic Electronic Payment Database Management System within a maximum period of 10 days from the date of change.

The traffic account owner is fully liable if they fail to notify the road use payment service provider as stipulated in this clause.
