Recently, the Government of Vietnam issued Decree 10/2012/ND-CP detailing the implementation of judicial education measures at communes, wards, and commune-level towns for juvenile offenders in Vietnam.
Guidance on Dossier on monitoring juvenile offenders under educational measures in Vietnam (Internet image)
According to Article 7 of Decree 10/2012/ND-CP, the records for implementing and monitoring the progress of juvenile offenders subject to educational measures at commune-level administrative units in Vietnam, include the following:
- Personal background of the educated individual;
- Personal profile, fingerprints;
- Copy of the court sentence or decision;
- Report on the implementation of educational measures at commune-level administrative units for juvenile offenders;
- Decision of the People's Committee at the commune level or social organization or school assigning a person to directly monitor, educate, and assist the educated individual;
- Commitment to correct mistakes by the educated individual, with confirmation from their parents or guardian;
- Minutes of review meetings by the People's Committee at the commune level, social organization, or assigned school responsible for monitoring and educating;
- Monthly reports and assessments by the person directly monitoring, educating, and assisting the educated individual regarding compliance with the law and obligations;
- Monthly report by the educated individual on their study, work, training, and progress;
- Self-review reports (every three months) by the educated individual, with comments from the person directly assigned to monitor and educate;
- Record of statements by the educated individual (if any);
- Documents related to absences from the residence, changes in residence by the educated individual as specified in Articles 10 and 11 of Decree 10/2012/ND-CP (if any);
- Court decision on the termination of the educational measures period at commune-level administrative units for juvenile offenders, if the period is terminated;
- Certificate of completion of educational measures at commune-level administrative units for juvenile offenders;
- Other related documents (if any).
More details can be found in Decree 10/2012/ND-CP, which comes into effect in Vietnam from April 10, 2012.
