On August 23, 2024, the Director-General of the Civil Aviation Authority of Vietnam issued Decision 2005/QD-CHK, defining the functions, duties, and powers of the Inspectorate of the Civil Aviation Authority of Vietnam.

Duties and powers of the inspectorate of the Civil Aviation Authority of Vietnam from August 23, 2024

According to Article 2 of Decision 2005/QD-CHK, the Inspectorate of the Civil Aviation Authority of Vietnam will have the following duties and powers:

- Perform duties and exercise powers according to the Law on Inspection, the Law on Civil Aviation of Vietnam, Decree 43/2023/ND-CP detailing a number of articles and enforcement measures of the Law on Inspection, Decree 03/2024/ND-CP regarding agencies performing specialized inspection functions and activities of agencies assigned to perform specialized inspection functions, and other relevant legal documents.

- Act as the lead consultant in drafting and organizing the implementation of legal documents and guidelines on specialized aviation inspections, administrative violations in the field of aviation, citizen reception, complaint resolution, denunciations, and anti-corruption measures.

- Lead the development of the annual inspection plan for the Inspectorate of the Civil Aviation Authority of Vietnam, report to the Director-General of the Civil Aviation Authority of Vietnam for review and approval before submitting it to the Inspectorate of the Ministry of Transport for inclusion in the ministry's inspection plan.

- Advise and assist the Director-General regarding:

+ Inspection work and penalties for administrative violations according to the law;

+ Addressing overlaps, duplications in inspection and audit activities according to regulations;

+ Monitoring and urging the implementation of inspection, examination, and audit conclusions by state agencies for the Civil Aviation Authority of Vietnam;

+ Summarizing and presenting the annual sectoral inspection and oversight plan of the agencies and units under the Civil Aviation Authority of Vietnam; monitoring the sectoral inspection and oversight of the Civil Aviation Authority of Vietnam after issuance;

+ Citizen reception; resolution of complaints, denunciations, reflections, and petitions;

+ Anti-corruption and negative measures;

+ Managing the inspection database; citizen reception and resolution of complaints, denunciations; anti-corruption and negative measures;

+ Supervising the examination and issuance of licenses, assessing the English proficiency of aviation personnel;

+ Internal inspection and supervision of the activities of the agencies and units under the Civil Aviation Authority of Vietnam according to the Director-General's delegation.

- Suggest or recommend to competent authorities to improve policies and laws on civil aviation sector management; propose to competent authorities to suspend or cancel illegal regulations discovered through inspection; recommend applying measures to address and rectify violations in civil aviation activities.

- Propagate and disseminate laws on inspections; administrative violation penalties; citizen reception; resolution of complaints, denunciations; anti-corruption, and negative measures.

- Train and guide on administrative violation penalty procedures; citizen reception; resolution of complaints, denunciations; anti-corruption, and negative measures.

- Summarize and report on the results of specialized inspections; administrative violation penalties; citizen reception; resolution of complaints, denunciations; anti-corruption, and negative measures within the management scope of the Civil Aviation Authority of Vietnam.

- Implement the provisions in Articles 2, 3, 4, 5 of Decision 2650/QD-CHK of 2023 defining the functions, duties, and powers of the Departments and Offices under the Civil Aviation Authority of Vietnam.

- Perform other tasks assigned by the Director-General.

It is known that the Inspectorate of the Civil Aviation Authority of Vietnam is an agency under the Civil Aviation Authority of Vietnam performing specialized aviation inspection functions within the state management scope of the Civil Aviation Authority of Vietnam assigned for management; performing citizen reception tasks, resolving complaints, denunciations, and preventing corruption and negative actions according to the law.

The Inspectorate of the Civil Aviation Authority of Vietnam operates under the direction and administration of the Director-General of the Civil Aviation Authority of Vietnam and under the guidance of the Inspectorate of the Ministry of Transport.
