Decree 52/2019/ND-CP: Dossier for Pardon Proposal under New Regulations

This content is stipulated in detail in Decree 52/2019/ND-CP detailing certain provisions of the Law on Amnesty.

According to Decree 52/2019/ND-CP, from August 01, 2019, the application dossier for amnesty includes the following documents:

- A petition for amnesty from the person sentenced to imprisonment.- A written commitment from the person sentenced to imprisonment regarding the non-violation of laws, continued fulfillment of obligations to return property, compensate for damages, and other civil obligations.- In case the person sentenced to imprisonment is one who has made significant contributions during the period of imprisonment, a person with merits to the revolution, a relative of a person with merits to the revolution; a person suffering from a serious illness, or a person who is frequently ill and unable to serve themselves; ... it is required to have proof documents.- The original or a copy of the documents showing that the person sentenced to imprisonment has completed additional penalties such as paying fines, court fees, returning assets, compensating for damages, and other civil obligations.- The original or a copy of the document from the individual entitled to enforce the judgment agreeing to the postponement or exemption of the sentence for returning assets, compensating for damages, and other civil obligations for non-state-owned assets.- For foreigners sentenced to imprisonment, a copy of the Passport or international travel document with an entry visa is required.- A written proposal for amnesty from the Amnesty Review Council of the prison, detention camp, district-level criminal enforcement agency, Provincial People's Court or Military Zone-level Military Court.- For persons sentenced to imprisonment who are temporarily suspended from serving their sentence, in addition to the above documents, there must be a decision on temporary suspension of serving the imprisonment sentence; an assessment document from the Commune-level People's Committee or the military unit assigned to manage that person regarding their compliance with the law during the period of temporary suspension.
