According to the provisions of Article 5 of Circular 38/2019/TT-NHNN, enterprises providing public postal services (hereinafter referred to as service providers) shall formulate and issue internal procedures for collections and payments services. The procedures must clearly define steps, processing stages, inspection, control contents, and specific responsibilities for each unit and individual implementing the process to ensure quick, accurate, safe, and legal compliance.
To perform collections and payments services, the collecting party or the paying party must provide the service provider with the necessary documents and materials related to the amount to be collected or paid as a condition for the service provider to execute the collections and payments. The service provider shall perform collections and payments in accordance with the content of the contract/agreement with the collecting party or paying party and in compliance with the relevant legal provisions.
To be specific, based on each type of collections and payments service, the service provider shall enter into a contract/agreement with the customer using the service to ensure the following basic content:
- Contract/agreement number;- Date of establishment (day, month, year);- Names and addresses of the parties involved;- Agreement on the processing time for payment transactions and settlements;- Scope of service provision;- Customer subjects;- Transaction location;- Implementation of safety and security measures;- Contents regarding the rights and obligations of the parties;- Responsibilities for coordination in handling inquiries, complaints, and disputes during the implementation process, specifying the responsibilities of the parties in receiving customer information, processing time, responsibility, and compensation plans for incurred losses;- Regulations on collection and payment fees;- Other contents agreed upon by the parties in accordance with this Circular and relevant legal provisions.
