The following article discusses the entities authorized to approve planning tasks, urban and rural planning in Vietnam from July 1, 2025, as stipulated in the Urban and Rural Planning Law 2024.
Which authorities have the power to approve planning tasks, urban and rural planning in Vietnam from July 1, 2025? (Image from Internet)
According to Article 41 of the Urban and Rural Planning Law 2024, the entities empowered to approve planning tasks, urban and rural planning in Vietnam include:
- The Prime Minister of Vietnam approves the following planning tasks, urban, and rural plans:
+ General plans for central-affiliated cities, general plans for provincial cities classified as Level I urban areas, general plans for new urban areas within the province or central-affiliated city with a projected population equivalent to Level I urban areas, general plans for new urban areas affecting administrative boundaries of two or more provinces;
+ General economic zone planning, national tourism area general planning; general planning of cities and district-level towns in cases specified in Clause 3, Article 5 of the Urban and Rural Planning Law 2024;
+ General plans, subdivision plans, detailed plans of areas of national significance in terms of politics, culture, history, security, and defense as identified in national-level planning, regional planning, general plans for central-affiliated cities;
+ Urban and rural plans organized by the Ministry of Construction according to Clause 1, Article 17 of the Urban and Rural Planning Law 2024;
+ Detailed plans for defense and security projects needing to ensure state secrets.
- Provincial People's Committees approve planning tasks, urban and rural plans within their administrative boundaries in the following cases:
+ Underground space planning, technical infrastructure specialized planning of central-affiliated cities;
+ General plans for cities, district-level towns, commune-level towns, new urban areas, and general plans for districts, except for the plans specified in points a and b of Clause 1, Article 41 of the Urban and Rural Planning Law 2024;
+ Subdivision plans in special urban areas, Level I urban areas, and new urban areas with a population scale equivalent to Level I urban areas; subdivision plans, and detailed plans for functional areas affecting the administrative boundaries of two or more district-level administrative units, except for plans specified in points c, d, đ of Clause 1 and Clause 4, Article 41 of the Urban and Rural Planning Law 2024.
- District-level People's Committees approve planning tasks, commune general plans, subdivision plans, and detailed plans within their administrative boundaries, except for plans specified in Clauses 1, 2, and 4, Article 41 of the Urban and Rural Planning Law 2024.
- Agencies, organizations established by the Prime Minister of Vietnam assigned to manage functional areas, and agencies, organizations under provincial People's Committees assigned to manage functional areas, have the authority to approve functional area planning tasks, subdivision plans, detailed functional area plans.
For subdivision plans and detailed functional area plans, prior to approval, a written agreement must be obtained from the specialized agency on urban and rural planning under the provincial People's Committee ensuring conformity with the provincial technical infrastructure connectivity requirements and compliance with standards and regulations applied in the planning content.
