Conditions for Considering Rank Promotion for Officers Retiring Before the Age Limit

Recently, the Ministry of Public Security issued Circular 17/2013/TT-BCA providing guidance on the promotion of ranks and salary grades for police officers and public security employees upon retirement.

According to regulations in Article 5 of Circular 17/2013/TT-BCA, officers retiring before the maximum service age limit by 04 years or more, if meeting the standards and conditions for promotion in rank and salary grade, will be considered for promotion in rank and salary grade 03 months before the pension commencement. Specifically:

- If the current rank and salary grade are lower than the maximum rank and salary grade prescribed for the position or title held, the officer will be promoted to the next adjacent rank and salary grade;- If the officer has been receiving the highest rank for 2/3 of the term or more, they will be granted the first salary grade increment;- If the officer has been receiving the first salary grade increment for 2/3 of the term or more, they will be granted the second salary grade increment and promoted to the next adjacent rank. If the officer has been receiving the second salary grade increment, they will be promoted to the next adjacent rank (except for individuals not eligible for promotion under Clause 2, Article 7).

For officers retiring before the maximum service age limit by less than 04 years, if meeting the standards and conditions for promotion in rank and salary grade before retiring in anticipation, the promotion in rank and salary grade will be considered from the month they start awaiting retirement.

Note regarding continuous service of 15 years or more (up to the point of awaiting retirement) in areas with exceptionally difficult socio-economic conditions, areas with a regional allowance coefficient of 0.50 or higher, or island districts retiring before the maximum service age limit, promotion in rank and salary grade will be implemented as for officers retiring at the maximum service age limit.
