Circumstances in Which the Right to Refuse to Receive Citizens Applies

The Law on Citizen Reception 2013 was promulgated on November 25, 2013. This law clearly stipulates the rights and obligations of complainants, denunciators, petitioners, and reporters, as well as identifying cases in which citizen reception officers have the right to refuse to receive citizens.

To be specific:, according to Article 7 of the Law on Citizen Reception 2013, the rights and obligations of individuals filing complaints, denunciations, petitions, or feedback are stipulated as follows:

- When arriving at the citizen reception place, individuals filing complaints, denunciations, petitions, or feedback have the following rights:- To present the content of the complaint, denunciation, petition, or feedback;- To receive guidance and explanations regarding the content related to their complaint, denunciation, petition, or feedback;- To file complaints and denunciations about illegal acts of the citizen reception officials;- To receive notifications about the reception, results of the handling of their complaints, denunciations, petitions, or feedback;- In cases where the individual is not proficient in Vietnamese, they have the right to use an interpreter;- Other rights as stipulated by the laws on complaints and denunciations.

- When arriving at the citizen reception place, individuals filing complaints, denunciations, petitions, or feedback have the following obligations:- To clearly state their full name, address, or present identification documents, authorization documents (if any);- To maintain proper attitude and respect toward the reception officials;- To truthfully present events, provide information, and documents related to the content of the complaint, denunciation, petition, or feedback; to sign or fingerprint to confirm the content presented that has been recorded by the reception officials;- To comply with the citizen reception regulations and the instructions of the reception officials;- In cases where multiple individuals file complaints, denunciations, petitions, or feedback on the same content, they must appoint a representative to present the content;- To be responsible before the law for the content of their complaint, denunciation.

However, there are circumstances under which the law permits citizen reception officials to refuse to receive individuals at the citizen reception place, specifically:

- Individuals under the influence of stimulants, individuals with mental illness, or other illnesses that impair awareness or control over their behavior;- Individuals who exhibit threatening or disrespectful behavior towards the agency, organization, unit, reception staff, or public servants, or engage in other actions that violate the regulations of the citizen reception place;- Individuals filing complaints, denunciations, about cases that have been resolved in accordance with policies and laws, have been reviewed, inspected, and notified in writing by the competent state agency, and have been received, explained, and guided previously but continue to complain or denounce persistently;- Other cases as prescribed by the law.

These contents are stipulated in Article 9 of the Law on Citizen Reception 2013.
