Circular 14: Duties and Powers of Departments under the General Department of Market Management

Recently, the Ministry of Industry and Trade issued Circular 14/2020/TT-BCT providing guidelines on certain regulations for industry and trade sector inspections, effective from August 15, 2020.

Article 5 Circular 14/2020/TT-BCT stipulates 06 duties and powers of the Department under the General Department of Market Management, which include:

  1. Develop and submit the annual inspection plan to the General Department for aggregation and submission to the Ministry's Inspectorate for the Minister's approval.
  2. Submit adjustments to the inspection plan to the General Department for aggregation and submission to the Ministry's Inspectorate for the Minister's approval.
  3. Implement the annual inspection plan after it is approved by the Minister.
  4. Appoint officials from the agency to join inter-sectoral inspection teams at localities headed by local Departments, Committees.
  5. Resolve complaints, denunciations, and arising issues during the implementation of the sectoral inspection tasks as per the management hierarchy.
  6. Implement reporting and information policies periodically and ad-hoc as stipulated.

Additionally, this Circular also stipulates the duties and powers of heads of agencies assigned to perform specialized inspection functions as follows:

- Specifically define the functions, duties, and powers of advisory units, heads of advisory units, and the working relationship between advisory units and other departments within the agency regarding specialized inspection and administrative violation handling work.- Decide on the assignment of officials under their management who meet the conditions and standards to perform specialized inspection duties.- Propose the Ministry of Industry and Trade to issue inspection credentials to those who meet the conditions.- Temporarily suspend the use of credentials as prescribed in Article 12 of this Circular, revoke credentials as prescribed in Article 13 of this Circular and send them to the Ministry's Inspectorate.- Be responsible for the standards of persons assigned to perform specialized inspection functions and for proposing the issuance of credentials.
