Circular 04/2010/TT-BCT: What are the responsibilities of the issuers of C/O form S in Vietnam?

Issuers of C/O form S in Vietnam specified in Circular 04/2010/TT-BCT on implementation of the rules of origin provided in the agreement between the ministry of industry and trade of the socialist republic of Vietnam and the ministry of industry and trade of the Lao people's democratic republic on rules of origin applicable to goods eligible for Vietnam-Laos preferential import tariff treatment, have the following responsibilities.

Article 4 of Circular 04/2010/TT-BCT stipulates that the issuers of C/O form S in Vietnam have the following responsibilities:

  • Instruct the applicant to issue C/O if requested;
  • Receive and check trader dossiers and C/O application dossiers;
  • Verify the actual origin of goods when necessary;
  • Issuing C/O when the goods meet the origin regulations of this Circular and the C/O applicant complies with the provisions in Article 3;
  • Submit sample signatures of those authorized to sign the C/O and the seal of the C/O issuing organization to the Ministry of Industry and Trade (Department of Import and Export) according to the regulations of the Ministry of Industry and Trade for registration with the competent authority. of the importing country;
  • Resolve complaints related to the issuance of C/O according to authority;
  • Verify the origin of exported goods at the request of the competent authority of the importing country;
  • Exchange information related to C/O issuance with other C/O issuing organizations;
  • Implement reporting regime, fully participate in professional training courses on origin and other requirements according to regulations of the Ministry of Industry and Trade.
