Minister of Home Affairs of Vietnam issued Circular 13/2022/TT-BNV guiding the determination of the rank structure of civil servants.
Basis for determining official paygrade structure in Vietnam (Internet image)
- The determination of the official paygrade structure of each agency, administrative organization of the ministries, branches and localities shall be based on:
+ The list of job positions for specialized professional civil servants and for professional civil servants for common use, guided by the Ministry of Home Affairs and line and field management ministries according to the provisions of Decree 62/2020/ND-CP on employment positions and civil servant paygrades;
+ The complexity of the job and the number of civil servants to be arranged according to each job position in the agency or organization approved by the competent authority;
+ Standards for titles and titles of specialized civil servants corresponding to the working position.
- When determining the structure of civil servant ranks in administrative agencies and organizations, civil servants holding leadership and management positions are not counted.
- The head of the agency employing civil servants shall base itself on Clause 1, Article 2 of this Circular 13/2022/TT-BNV and use the list of job positions and the number of civil servants arranged according to each job position at their agency or organization to determine the percentage (%) of civil servants holding civil servant ranks according to each specialty at agencies or organizations, and report to competent agencies for approval.
- The head of the agency managing civil servants shall approve the official paygrade structure suitable to the complexity of the job according to the job position, nature, characteristics, and scale of operation of the agency employing the civil servant.
- The department in charge of personnel organization of agencies, organizations and units is responsible for advising and assisting the head in determining the number of civil servant ranks and official paygrade structure of agencies, organizations and units to submit to competent authorities for consideration and decision.
Ministries, ministerial-level agencies, government-attached agencies, and organizations established by the government or the prime minister that are not public non-business units, the People's Committee of the province or city directly under the Central Government determine the rank structure of civil servant ranks of each administrative agency and organization within its management competence, which serves as a basis for the implementation of Circular 13/2022/TT-BNV.
- Ministries, branches, and localities shall summarize and report on the results of determining the official paygrade structure of each administrative agency and organization under their management according to Appendices 01 and 02 and the Job Position Scheme approved by the competent authority for submission to the Ministry of Home Affairs for management in accordance with the law.

- If the structure of civil servant ranks of agencies, organizations, ministries, branches, and localities changes, report it to the Ministry of Home Affairs immediately for consensus before organizing implementation.
