Circular 02/2018/TT-BNNPTNT was issued by the Ministry of Agriculture and Rural Development on January 31, 2018, detailing the documentation required for the certification of exploited aquatic products.
Accordingly, Circular 02 stipulates that shippers who require certification of exploited aquatic products must submit 02 (two) sets of documents to one of the competent authorities directly or by postal mail to request certification of exploited aquatic products.
The dossier requesting certification of exploited aquatic products comprises:
- A sample Certificate of exploited aquatic products or another sample certificate as required by the competent authority of the importing country. In the case where the shipment uses raw materials from more than 01 (one) vessel or the raw materials are purchased from 01 (one) vessel but processed into multiple shipments, additional information must be included;- A Transport Information Declaration Appendix;- A photocopy of the Certificate of Origin of Exploited Aquatic Products;
Additionally, Circular 02 also stipulates that within no more than 02 working days from the date of receipt of the shipper's dossier, the competent authority shall review the dossier, verify the information in the Certificate of Exploited Aquatic Products and:
- Certify the shipment if its contents are accurate according to the declaration in the Certificate of Exploited Aquatic Products and return 01 (one) set of documents to the shipper, 01 (one) set to the competent authority;- Not certify the shipment if its contents are inaccurate according to the declaration in the dossier or if the raw materials come from vessels listed as engaging in illegal fishing. In the case of non-certification, a written response must be provided to the shipper, clearly stating the reasons.
The competent authority shall return the results directly or via postal mail to the shipper.
The shipper shall pay the appraisal fee for certification of the origin of exploited aquatic products according to the provisions of the law on fees and charges.
