Regarding this matter, LawNet would like to answer as follows: 

On March 12, 2024, the Minister of the Ministry of Science and Technology of Vietnam issued Decision 361/QD-BKHCN on the 2024's Work Plan for State Compensation Liability.

The Ministry of Science and Technology has outlined the following tasks in 2024's Work Plan for State Compensation Liability that need to be carried out:

- Carry out dissemination and promotion of legislative documents on the State Compensation Liability to officials and public employees of the units under the Ministry, including Decision 3408/QD-BKHCN dated December 28, 2021, issued by the Minister of the Ministry of Science and Technology on promulgation of the procedures for handling compensation requests within the State Compensation Liability of the Ministry of Science and Technology using appropriate and effective methods.

- Provide guidance on the settlement of State Compensation Liabilities, address difficulties in implementing the laws on State Compensation Liability in management activities.

- Within the scope of their functions, tasks, and authorities, the units under the Ministry shall manage State Compensation Liabilities in accordance with the provisions of Clauses 1, 5, 6, and 7 of Article 33 of the Law on State Compensation Liability in 2017 and perform tasks specified in Article 75 of the Law on State Compensation Liability in 2017, as follows:

+ Coordinate closely with the Ministry of Justice in the state management of compensation work within the national scope in the respective fields/sectors.

+ Inspect, supervise, and resolve complaints and denunciations regarding State Compensation Liabilities in accordance with the law.

+ Carry out compensation settlement work, determine the responsibility for reimbursement, implement decisions on reimbursement, and handle disciplinary actions within the jurisdiction.

+ Handle and direct the handling of violations in the process of compensation settlement, fulfill the responsibility for reimbursement.

+ Annually or as required by the leading unit of the Ministry, compile statistics and report on the implementation of State Compensation Liabilities.

+ Respond to and implement recommendations from state management agencies regarding State Compensation Liabilities; provide information as stipulated by the Law on Access to Information.

+ Organize training on skills and specialized knowledge related to State Compensation Liabilities for the officials and public employees entrusted with State Compensation Liabilities within the Ministry's management scope to ensure strict compliance with the laws on State Compensation Liabilities, especially the provisions on the participation of state management agencies in the process of handling compensation requests.

+ Perform other duties and powers as prescribed by the laws on State Compensation Liabilities.

When carrying out the assigned tasks, the following purposes and requirements must be ensured:

(1) Purposes

- Implement the State Compensation Liabilities in a synchronized and effective manner as stipulated by the law; ensure the feasibility of compensation mechanisms in the Ministry of Science and Technology's management scope.

- Raise awareness of the significance and importance of State Compensation Liabilities among officials and public employees in the units under the Ministry.

(2) Requirements

- The leaders of specialized units under the Ministry must pay attention to and direct their participation in activities such as dissemination, training, and professional development related to State Compensation Liabilities within their respective agencies, in accordance with the provisions of the law.

- Carry out the tasks promptly, publicly, fairly, in good faith, honestly, and in accordance with the law.

- Conduct negotiations between the responsible agency and the injured party, their successors, or their legal representatives.
