04 principles for converting Notary Offices applicable from May 01, 2015

Decree 29/2015/ND-CP on the organization and operation of the inspection sector in Agriculture and Rural Development was issued on March 15, 2015

Decree 29/2015/ND-CP stipulates four principles for the conversion of Public Notary Offices applicable from May 1, 2015, as follows:

1. The Notary Office established from the conversion of the Public Notary Office must inherit all rights, obligations, and receive all notarization records of that Public Notary Office.

2. Ensure policies for notaries, public employees, and workers after the Public Notary Office ceases its activities in accordance with the law on public employees and labor law.

3. The Notary Office established from the conversion of the Public Notary Office must sign labor contracts with notaries, public employees, and workers of that Public Notary Office, except in cases where these individuals do not wish to continue working at the Notary Office. The contents, terms, and conditions of the contract shall be implemented in accordance with this Decree and other relevant legal provisions.

4. Ensure that state-owned assets managed and used by the Public Notary Office are handled in accordance with the law and are not lost during the conversion process.

In addition, the conversion of the Public Notary Office aims to meet the following objectives and requirements:

- Continue to implement the policy of socializing notarization activities.- Ensure the harmonization of interests between the State, notaries, public employees, and workers working at the converted Public Notary Office.- Implement publicly, transparently, democratically, and objectively in accordance with the Law on Notarization, this Decree, and other related legal documents, ensuring the continued maintenance and inheritance of the activities of the converted Public Notary Office.- Implement according to the roadmap, in line with the overall development plan for notary practice organizations approved by the Prime Minister of the Government of Vietnam.
