Who is Responsible for Remedying Construction Defects?

According to Clause 3, Article 45 of Decree 06/2021/ND-CP on the resolution of construction work incidents, in which:

The investor, construction contractor during the construction process, or the owner, manager, and user of the construction during the exploitation and use process are responsible for rectifying the incident at the request of the competent state authority. After rectifying the incident, the competent authority stipulated in Clause 2 of this Article shall decide on the continuation of construction or putting the structure into use.

Thus, the investor, construction contractor during the construction process, or the owner, manager, and user of the construction during the exploitation and use process shall be responsible for rectifying the incident at the request of the competent state authority.
