Which Projects Are EPC Contracts Applied To?
At Point d Clause 2 Article 1 of Decree 50/2021/ND-CP, it is stipulated:
EPC contracts are prioritized for complex projects that require high technical and technological standards and must strictly adhere to uniformity and consistency from the design phase to the equipment supply, construction, and technology transfer training phases. Before deciding to apply the EPC contract type, the investment decision-maker is responsible for organizing the assessment of technical and technological requirements, shortening the project implementation time, ensuring uniformity from the design phase, equipment supply, construction of works to the training in operations, and transfer of works to meet the approved project's objectives and requirements and ensure the feasibility of applying the EPC contract compared to other types of contracts.
Furthermore, the Decree also stipulates:
Design - Procurement of materials and equipment - Construction contracts (abbreviated as EPC contracts) are contracts to carry out tasks from design, procurement of materials and equipment to construction of works, project items, and trial operation, acceptance, and handover to the contractor; the EPC general contract is a contract for the design - procurement of materials and equipment - construction of all works of an investment construction project.
