Which agency has the authority to preside over construction appraisal?
Clause 2, Article 6 of Decree 06/2021/ND-CP stipulates the agencies that have the authority to preside over construction appraisal as follows:
- The Provincial People's Committee organizes the appraisal for projects within its jurisdiction, except for cases specified in points b and c of this clause;
- The Ministry of Defense and the Ministry of Public Security organize the appraisal for national defense and security projects;
- The Ministry managing specialized construction works organizes the appraisal for construction projects when assigned by the Prime Minister of the Government of Vietnam;
- The authority to preside over the appraisal of the cause of incidents as prescribed in Clause 1, Article 46 of this Decree.
What is the order of implementing construction appraisal?
Based on Article 5 of Circular 10/2021/TT-BXD, the provisions are as follows:
The order of implementing construction appraisal:
a) The competent authority presiding over the organization of construction appraisal (referred to as the appraisal agency) notifies in writing to the investor, owner, or manager/user of the project about the organization of the appraisal with main contents, including: base for implementation, object, time, and content of the appraisal;
b) The investor, owner, or manager/user of the project is responsible for gathering documents, materials, and technical data related to the object of the appraisal as requested by the appraisal agency;
c) The appraisal agency organizes the implementation of construction appraisal based on documents, materials, related technical data, and inspection results (if any). If necessary, the appraisal agency appoints a suitable construction inspection organization to conduct inspections to serve the appraisal work;
d) The appraisal agency notifies the appraisal conclusions as specified in Clause 2 of this Article to the relevant parties. If necessary, the appraisal agency organizes the collection of opinions from relevant organizations and individuals regarding the content of the appraisal conclusions.
