In what cases is a construction permit in Vietnam reissued?
Pursuant to Article 63 of Decree 175/2024/ND-CP on regulations on reissuing construction permits:
Article 63. Reissue of Construction Permits
- A construction permit is reissued under circumstances stipulated in Article 100 of the Construction Law 2014.
- The application for reissuance of a construction permit, specifying the reason for reissuance, follows Form No. 02 of Appendix II of this Decree.
A construction permit is reissued in cases where it is torn, damaged, or lost.
What are procedures for reissuing a construction permit in Vietnam?
Pursuant to Article 102 of the Construction Law 2014 (amended by Clause 36, Article 1 of the Amended Construction Law 2020) on the procedures for issuing, reissuing, adjusting, and extending construction permits:
Article 102. Procedures for Issuing, Reissuing, Adjusting, and Extending Construction Permits
- The procedures for issuing and adjusting construction permits are regulated as follows:
a) The investor submits 02 sets of application dossiers for issuing or adjusting construction permits to the competent authority for granting construction permits;
b) The competent authority receiving the application has the responsibility to inspect the dossiers, issue receipts for applications that meet the requirements, or provide guidance for the investor to complete the dossiers if they do not meet the regulations;
c) Within 07 working days from the receiving date of the application, the competent authority must conduct an appraisal of the dossiers and field inspections. During the appraisal, the authority must identify any missing or incorrect materials according to regulations or actual situations and communicate one-time written notification for the investor to supplement and complete the application. If additional documents are insufficient based on the notification, the competent authority must provide a written guide to further complete the application within 05 working days. The investor is responsible for supplementing and completing the application according to the written notification. If the supplemented application still does not meet the content as notified, the competent authority must notify the investor of the reasons for not granting a permit within 03 working days;
d) The competent authority compares the conditions set by this Law to send written requests for opinions from state management agencies on related construction fields according to the law;
dd) Within 12 days for constructions and detached houses from the receiving date of the application, the state management agencies consulted must respond in writing about the contents within their managerial functions. If these agencies do not have opinions after this period, it is considered as agreed, and they must be responsible for the contents within their managerial functions; the construction permit issuing authority makes decisions based on current regulations to issue construction permits;

a) The investor submits 02 sets of application dossiers for extension or reissuance of construction permits to the competent authority for granting construction permits;
b) Within 05 working days from receiving complete and valid dossiers, the competent authority is responsible for considering extending the construction permit or reissuing the construction permit.

The procedures for reissuing construction permits are conducted as follows:
Step 1: Submit application
The investor submits 02 sets of application dossiers for extension or reissuance of construction permits to the competent authority.
Step 2: Receive application
Step 3: Reissue construction permit
Within 05 working days from receiving complete and valid dossiers, the competent authority is responsible for considering extending the construction permit or reissuing the construction permit.
