What is function of the Construction Project Management Board under the Committee for Ethnic Minorities in Vietnam?

Pursuant to Clause 1, Article 2 of Decision 99/QD-UBDT in 2018 stipulating the functions of the specialized construction investment project management board as follows:

1. Function

1.1. Functions as an investor:

a) Act as the investor in projects funded by the state budget or non-budget state capital when assigned.

b) Receive and manage the use of capital for construction investment according to the provisions of law.

c) To perform the rights and obligations of the investor and the project management board as prescribed in Articles 68 and 69 of the Law on Construction and relevant laws.

d) Hand over the completed construction work to the owner who manages and uses the work upon completion of construction or directly manages, exploits and uses the completed work at the request of the investment decider.

1.2. Functions to receive investment project management entrustment:

Receive project management entrustment of other investors when assigned by the Minister, the Chairman and requested by the partners.

1.3. Other function:

a) Searching and exploiting works related to construction activities, including: Construction planning; make a report on proposal for investment policy; prepare economic and technical reports; make a feasibility study report; survey organization, construction design; construction supervision, project management, preparation of bidding documents, contractor selection, acceptance, handover and put into operation and use; warranty, construction maintenance and other activities related to the construction of works.

b) Perform other functions as assigned by the Minister, Chairman of the Committee for Ethnic Minorities.

What are regulations on tasks of the Management Board of specialized construction investment projects under the Committee for Ethnic Minorities in Vietnam?

According to Clause 2, Article 2 of Decision 99/QD-UBDT in 2018 stipulating the tasks of the Construction Investment Project Management Board as follows:

2. Mission

2.1. Perform the duties and powers of the Investor:

a) Develop and submit to the Minister, Chairman of the Committee for Ethnic Minorities for approval long-term, 5-year and annual plans of the Construction Investment Project Management Board; participate in the elaboration of long-term and annual development strategies, plannings and plans on construction investment of the Committee for Ethnic Minorities.

b) Project planning: Prepare and submit for approval the annual project implementation plan, which clearly identifies the resources to be used, the implementation schedule, the completion deadline, the quality objectives and the standards.

c) Organize the preparation of construction investment: Carry out procedures related to construction planning, use of land, natural resources, technical infrastructure and protection of landscape, environment, prevention and control, explosion-proof related to construction works; organize project formulation, submit project appraisal and approval according to regulations; receive and disburse investment capital and perform other project preparation works.

d) Project implementation tasks: Hire consultants to carry out survey, construction design and submit for appraisal, approval or organize the appraisal and approval of construction design and estimate (according to decentralization); assume the prime responsibility for, and coordinate with concerned agencies and organizations in, compensation, site clearance and resettlement (if any); recover, deliver and receive land for project implementation; organize the selection of contractors and sign construction contracts; supervise the process of implementation, disbursement, payment under construction contracts and other necessary jobs.

e) Tasks of finishing construction and handing over works for operation and use: Organizing the acceptance and handover of completed works; commissioning; settlement and liquidation of construction contracts, settlement of work construction investment capital and work warranty.

g) Financial management and disbursement tasks: Receiving and disbursing capital according to the project implementation schedule and the contract signed with the construction contractor; implement the financial and asset management regime of the PMU according to regulations.

h) Administrative tasks, coordination and accountability: Office organization and personnel management of the Project management; implement the salary regime, remuneration, reward and discipline policies for cadres and public employees under their management; establish an internal information system and store information; provide accurate and timely information and explanations on the operation of the specialized construction investment project management board at the request of investment deciders and competent state agencies.

i) Monitoring, evaluation and reporting tasks: Carrying out investment monitoring and evaluation in accordance with the law; periodically evaluate and report on project implementation results to investment deciders and competent state management agencies.

2.2. Project management duties:

a) Organize the implementation of project management contents as prescribed in Articles 66 and 67 of the Law on Construction.

b) Coordinating activities with organizations and individuals participating in project implementation to ensure requirements on progress, quality, cost, safety and environmental protection.

c) To use funds from project management expenses and other lawful sources (if any) to ensure the operation of the Project management according to state regulations on management and use project management costs.

d) Managing a contingent of civil servants, public employees and employees; implement financial, accounting and asset management regimes in accordance with law.

e) Implement the regime of periodic or extraordinary information and reports as prescribed.

f) Perform other project management tasks assigned or authorized by the investment decider or investor.

2.3. Project management mandate:

To comply with the project management entrustment contract signed with other investors, in accordance with their operational capacity (follow Article 12 of Circular No. 16/2016/TT-BXD of the Ministry of Construction).

2.4. Supervision of construction works:

To supervise the construction of works according to the provisions of law for signed contracts.

2.5. Perform other duties:

Perform other duties as assigned by the Minister, Chairman of the Committee for Ethnic Minorities.

2.6. Specific tasks after merger:

a) Perform the investor's duties for the project to build the Headquarters of the Representative Office of the Committee for Ethnic Minorities in Ho Chi Minh City according to the Minister's Decision No. 219/QD-UBDT dated April 27, 2017, Chairman of the Committee for Ethnic Minorities.

b) Perform project management for the construction project of the Ethnic Minority Academy under the entrustment contract No. 01/2017/HDUT dated June 2, 2017 between the Academy of Ethnic Minorities and the specialized investment project management board. build.

c) Receive and perform the tasks of the Investor for the project to build the Headquarters of the Committee for Ethnic Minorities and the project to apply solar power for mountainous areas and ethnic minorities in Vietnam. The implementation of these two projects is in accordance with the Regulation on organization and operation of the Project management approved by the Minister, the Chairman of the Committee for Ethnic Minorities and in accordance with relevant laws.
