What are the responsibilities of construction contractors in managing construction order in Ho Chi Minh City?

Pursuant to Article 26 of the Regulation on coordination in management of construction order in Ho Chi Minh City issued together with Decision 30/2019/QD-UBND of Ho Chi Minh City stipulating responsibilities of construction contractors in managing construction order in Ho Chi Minh City as follows:

1. Strictly abide by the provisions of the law on construction.

2. Stop the construction of works that violate the construction order when there is a request from a competent authority to stop the construction; comply with the requirements in the notices and sanctioning decisions of the competent State management agencies. In case of failure to comply with decisions on sanctioning of administrative violations issued by competent state agencies, construction contractors will be considered for deprivation of construction operation capacity certificates according to regulations.

3. Compensate for damage caused by their violations.

4. Other responsibilities as prescribed by law.

What are the responsibilities of the design and supervision consultant contractor on construction management in Ho Chi Minh City?

Pursuant to Article 27 of the Regulation on coordination in management of construction order in Ho Chi Minh City issued together with Decision 30/2019/QD-UBND of Ho Chi Minh City stipulating responsibilities of the design consultant contractor on construction management in Ho Chi Minh City as follows:

1. Comply with the provisions of law in the design and construction of works.

2. Design works in accordance with construction planning already approved by competent authorities.

3. Supervise construction designers during the construction process; In the process of supervising construction designers according to regulations, if detecting construction works against the design appraised and approved by the State management agency, promptly report it to the Inspector of the Department of Construction, People's Committee of district, People's Committee of commune to inspect and handle according to regulations.

4. Other responsibilities as prescribed by law.

Pursuant to Article 28 of the Regulation on coordination in management of construction order in Ho Chi Minh City issued together with Decision 30/2019/QD-UBND of Ho Chi Minh City stipulating responsibilities of the supervision consultant contractor on construction management in Ho Chi Minh City as follows:

1. Strictly abide by the law provisions on construction.

2. Supervise the construction of works according to construction permits, construction plannings, and designs which have been appraised and approved by competent authorities. When detecting a violation of construction order at the construction site under their supervision, in addition to promptly proposing the investor to take remedial measures for the violation, the supervision consultant contractor is responsible for sending a written notice to the Inspector. The Department of Construction, the People's Committee of the district and the People's Committee of the commune where the violating works are located shall notify the violation of construction order.

3. In case of failure to comply with decisions on sanctioning administrative violations of competent State agencies, the supervision consultancy contractor shall be considered for deprivation of construction operation capacity certificates as prescribed.

4. Other responsibilities as prescribed by law.

What are regulations on reflecting information on violations of the law on construction order in Vietnam?

Pursuant to Article 29 of the Regulation on coordination in management of construction order in Ho Chi Minh City issued together with Decision 30/2019/QD-UBND of Ho Chi Minh City stipulating regulations on reflecting information on violations of the law on construction order in Vietnam as follows:

1. All agencies, organizations and individuals, when detecting violations of the law on construction order, have the right to report information to State agencies and competent persons specified in Article 2 of this Law. 30 of this Regulation, to be verified, handled according to regulations.

2. State agencies responsible for receiving information specified in Article 30 of this Regulation must set up voice mail boxes; hotline phone number; email box; information receiving number at the head office of the agency or unit; at the same time, there is a plan to organize and assign a duty schedule, who directly receives the reflected information, to monitor and process information reflecting violations of the law on construction order as prescribed.

3. Individuals responsible for receiving information specified in Article 30 of this Regulation must disclose personal phone numbers and ensure 24-hour contact, in order to promptly receive information reflecting the violations of the law on construction order and direct handling according to regulations.

4. District-level People's Committees develop online software applications to receive people's feedback on planning, land and construction order in the area.
