Pursuant to Clause 2, 3, 4, 5 and 6, Article 25 of the Circular 04/2022/TT-BXD (takes effect from 01/01/2023) stipulating the description of dossiers on projects on general planning for construction of special purpose zones in Vietnam as follows:

2. The description includes:

a) Analysis of location, assessment of natural conditions; current status of population, land use functions, landscape architecture, social and technical infrastructure and environment. Assessment of management and implementation according to the approved planning for space development, land use and technical infrastructure; comparison and contrast with orientations and indicators in the approved planning (if any); assessment of current status of programs and projects on development investment in progress within the areas Identification of underlying problems that must be handled.

b) Identification of objectives and the driving force of special purpose zone, identification of economic - technical indicators for each area in special purpose zone. Assessment and forecast about impacts of natural and socio-economic conditions; national planning, regional planning, provincial planning or technical planning that has been approved for orientation to the development of special purpose zone. Forecast about development indicators: population size, labour, land, social and technical infrastructure for the whole zone, urban and rural development areas (if any) and each special purpose zone.

c) Proposal and selection of structure of development of the space of special purpose area; identification of orientations and principles of the development of urban and rural residential development areas and other areas in special purpose zones (industry, tourism, services, ecology, conservation, .. .) and organization of central system.

d) Regulations on control of architecture and landscape in special purpose zone: Orientation to the development of space axes and development corridors as a basis for identification of indicators for population density and land use functions. Orientation and principles of the development of each special purpose area of ​​the planned area, system of squares, gateway areas, highlight works, key areas, areas where the underground works are expected to be built (if any) in special purpose zone.

dd) Technical infrastructure development orientation: Traffic (down to main regional roads), technical preparation, water supply, energy supply, telecommunications, solid waste management and cemeteries according to regulations of Point e Clause 1 Article 12 of Decree No. 44/2010/ND-CP.

g) Implementation plan: Rationales for identification of the list of planning, programs and projects given priority for investment according to the stages; proposal and recommendation of resources for implementation.

The description of the project on general planning for construction of special purpose zone shall have statistical tables, calculation appendices, illustrations and system of diagrams and drawings (A3 size) with symbols and notes enclosed with contents of each part of the relevant description.

3. Appendix attached to the description (explanations, additional rationales for description; illustration; calculated data). Appendices attached to relevant legal documents.

4. Regulations on management according to project on general planning for construction of special purpose zone: Contents shall comply with regulations of Clause 1 Article 15 of Decree No. 44/2015/ND-CP. The drawings (A3 size) must be attached.

5. Drafts of the Proposal and Decision on approval for projects on planning.

6. Appendix attached to the description (explanations, attached appendices, additional rationales for description; illustrations; calculated data). Appendices attached to relevant legal documents.

What are contents of dossiers on tasks in zoning planning for construction of special purpose zones in Vietnam?

Pursuant to Article 26 of the Circular 04/2022/TT-BXD (takes effect from 01/01/2023) stipulating contents of dossiers on tasks in zoning planning for construction of special purpose zones in Vietnam as follows:

1. With regard to special purpose zone that falls outside the area mentioned in the approved general urban planning or the approved general planning for construction of economic zone: the drawing includes diagram of location of the planned area which is shown in map of orientation to organization of space and functional zoning in the provincial planning and space development orientation diagram in the district planning (if any) at the appropriate scale; map of the research boundaries and the scope of the planned area which is shown in land use planning orientation map at the appropriate scale of the province.

With regard to special purpose zone that falls within urban area or area of special purpose zone mentioned in the approved general planning: the drawing includes diagram of location of the planned area (the drawing shall be shown in map of orientation of development of space of urban area or special purpose zone of the approved general planning at an appropriate scale); diagram of the research boundaries and the scope of the planned area which is shown at the appropriate scale in urban land use planning map or map of land use planning for special purpose zone according to the planning stages of the approved general planning.

2. The description includes:

a) Reasons, necessity and grounds for planning Rationales for the scope of the boundaries, area and properties of the planned area.

b) Overview of natural features and current status of the planned area Orientations to development in provincial planning (for special purpose zone that falls outside urban area), general urban planning or general planning for construction of special purpose zone and technical planning that have been approved or are in progress with impacts on the scope of planning. Preliminary identification of main problems that must be handled and requirements for concretization of the approved general planning and provincial planning 

c) Preliminary identification of population size, land, requirements for technical and social infrastructure for the planned area; proposal and selection of the applicable indicators on the basis of analysis and synthesis from the relevant planning that has been approved.

d) Requirement for the level of survey, collection of documents and data, assessment of current status of area; requirement for status database.

dd) Requirement for main contents of zoning planning.

e) Identification of the list of drawings, descriptions and attached appendices; the quantity and specifications of the dossiers on projects; cost estimates; plans and progress in organization of planning; identification of requirements for contents, forms and enquired entities.

3. Drafts of the Proposal and Decision on approval for the planning.

4. Other legal documents.

What are regulations on drawing included in dossiers on projects on zoning planning for construction of special purpose zones in Vietnam?

Pursuant to Clause 1 Article 27 of the Circular 04/2022/TT-BXD (takes effect from 01/01/2023) stipulating drawing included in dossiers on projects on zoning planning for construction of special purpose zones in Vietnam as follows:

1. The drawing includes:

a) Diagram of location and the boundaries of land plot: the diagram shall be shown at the appropriate scale in land use planning map of the province (for special purpose zone with a scale of less than 500 hectares that falls outside area mentioned in the approved general urban planning, general planning for construction of economic zones). The drawing shall be shown on space development orientation diagram and urban land use planning map according to the planning stages of general urban planning that has been approved (for special purpose zone within urban area) or space development orientation diagram and land use planning map according to the planning stages of general planning for construction of special purpose zones that has been approved (for area within special purpose zone).

b) Map of current status of land use and landscape architecture: Current status of land use functions as prescribed in Appendix V of this Circular; landscape architecture, social infrastructure system (education, health care, culture, commerce, trees, houses, ...), relic protection zones, scenic spots and other functions in the area. The drawing shall be shown in the topographic map at the scale of 1/2.000.

c) Maps of current status of systems of technical infrastructure and environmental protection: Traffic, electricity supply and lighting, communications, water supply, elevation, rainwater drainage, wastewater drainage; solid waste management, cemeteries and environment. The drawing shall be shown in the topographic map at the scale of 1/2.000.

d) Overall land use planning map. Identification of functions, area, population size, indicators for land use for each city block (divided by tertiary roads) in the planned area (according to regulations of Appendix V of this Circular); setback for the road axes (tertiary roads); location and scale of underground works (if any). Identification of location and scale of social infrastructure system at urban level or higher and at unit level in the area (if any). The drawing shall be shown in the topographic map at the scale of 1/2.000.

dd) Landscape architecture space organization diagram: The drawing shall be shown in the topographic map at the scale of 1/2.000.

e) Map of identification of underground work construction areas: public underground works, high-rise buildings with basements (if any). The drawing shall be shown on overall land use planning map in combination with topographic map at an appropriate scale.

g) Map of planning for traffic, red line boundaries and construction lines (down to intra-regional roads) The map shall be shown on overall land use planning map in combination with topographic map at the scale of 1/2.000.

h) Technical infrastructure system planning maps: Technical preparation, water supply, energy supply and lighting, wastewater drainage, solid waste treatment, cemeteries and other technical infrastructure works. The maps shall be shown on overall land use planning map in combination with topographic map at the scale of 1/2.000.

i) General map of technical pipelines and lines. The map shall be shown on overall land use planning map in combination with topographic map at the scale of 1/2.000.

k) Drawings of orientation, regulations on control of architecture and landscape in the planned area: Identification of indicators for control: Setback, landscape architecture along main road axes, central areas; open space areas, highlight works and each city block for the design area. The drawing shall be shown at the appropriate scale.
