Regulations on Land Use Requirements in Construction Planning
Requirements for land use in construction planning must ensure the requirements stipulated in Section 2.7.3 QCVN 01:2021/BXD National Technical Regulation on Construction Planning issued along with Circular 01/2021/TT-BXD. Specifically:
- Land use planning must prioritize land funds for the arrangement of public service works, green park land, and urban technical infrastructure to progressively achieve the standards of new urban areas;
- In cases where there is insufficient land fund to arrange public service works, it is permitted to reduce land use standards in Table 2.3 and Table 2.4 but not by more than 50%. Particularly for educational training facilities, national standards stipulated by the Ministry of Education and Training must be ensured;
- It is permitted to arrange kindergartens on the 1st and 2nd floors of apartment buildings, but playground areas, separate pathways for students, and regulations on environmental hygiene, fire prevention, and fighting must be ensured as prescribed by law and specialized regulations of the Ministry of Education and Training, the Ministry of Health;
- In cases where the unique characteristics of the planned area cannot supplement the public green space area to meet the requirements, the detailed planning and urban design project must propose adding green spaces, open spaces within the lots, and ensure everyone has access and use.
