Publication of Works That Have Reached the End of Their Design Lifespan Regulations
Based on Article 19 of Circular 10/2021/TT-BXD (Effective from October 15, 2021) stipulating the announcement of construction works that have exceeded their designed usage period as follows:
The owner or manager, user of the building shall prepare and send a report as stipulated in Clause 2, Article 41 of Decree No. 06/2021/ND-CP. The report includes the following main contents: the name of the construction work; the construction location; type and grade of the construction work; name and address of the owner or manager, user of the construction work; the main technical parameters of the construction work; designed usage period and the expiry date of the usage period of the construction work; proposed handling plan for the construction work after the expiry date of usage.
The competent state authority stipulated in Clause 4, Article 39 of Decree No. 06/2021/ND-CP shall perform the following tasks:
a) Review the appropriateness and accuracy of the contents in the report;
b) Announce the construction works that have exceeded their designed usage period in the list on the electronic information portal within their management authority, including the following main contents: the name of the construction work; the construction location; type and grade of the construction work; name and address of the owner or manager, user of the construction work; the main technical parameters of the construction work; designed usage period and the expiry date of the usage period of the construction work; requirements for the organization of demolition of the construction work and the timeline for carrying out the demolition as stipulated in Article 42 of Decree No. 06/2021/ND-CP in case the owner or manager, user of the construction work does not wish to continue using it.
