Legal Basis for National Land Use Planning and Planning under the Latest Regulations

According to the provisions of Article 6 of the Law on Amendments and Supplements to a Number of Articles of 37 Laws Related to Planning 2018 (effective from January 1, 2019), the basis for formulating national land use planning and plans is specifically stipulated as follows:

1. Basis for formulating national land use planning includes the following bases according to legal regulations on planning and the following bases:

- Natural, economic, and social conditions;

- Current land use status, land potential, and results of national land use planning implementation in the previous period;

- Land use needs of various sectors and fields at the provincial level.

The content of national land use planning is implemented in accordance with legal regulations on planning.

2. Basis for formulating national land use plans includes:

- National land use planning;

- The 5-year and annual socio-economic development plans of the entire country;

- 5-year land use needs of various sectors and fields at the provincial level;

- Results of implementing the national land use plan in the previous period;

- The capacity to invest and mobilize resources to implement the land use plan.

The content of the national land use plan includes:

- Analyzing and evaluating the results of implementing the national land use plan in the previous period;

- Determining the area of each type of land in the national land use planning for each 5-year land use planning period;

- The 5-year land use plan for each socio-economic region and provincial administrative unit;

- Solutions for implementing the land use plan.
