Does Adding Additional Floors Require Reissuance of a Construction Permit?
According to construction law regulations, a Construction Permit is only reissued in cases of being torn, damaged, or lost.
Therefore, according to Point b, Clause 1, Article 98 of the 2014 Construction Law, when you add a floor that affects the main load-bearing structure of the project, you must apply for an adjustment of the construction permit. To be specific, this point stipulates as follows:
During construction, when there is a change in any of the factors such as location, construction area; scale, height, number of floors of the project, and other factors affecting the main load-bearing structure, the investor must request an adjustment of the construction permit.
Along with that, the dossier requesting an adjustment of the construction permit includes:
- An application for adjustment of the construction permit;
- The original issued construction permit;
- Design drawings related to the adjustment compared to the design that has been granted the construction permit;
- Report on assessment results and written approval of the adjusted design (except for individual houses) from the investor, which must include content on ensuring load-bearing safety, fire and explosion prevention safety, and environmental protection.
In case you do not adjust the construction permit in this situation, you will be forced to dismantle the construction part that does not comply with the permit according to Article 30 of the 2012 Law on Handling Administrative Violations.
