Do renovation and installation of equipment in a religious building require a construction license in Vietnam? Does a dissolved religious educational institution have to be announced on mass media in Vietnam?
Does the religious church where I reside need to obtain a construction license for renovation and equipment installation? Is it necessary to announce the dissolution of a religious educational institution? Please advise.
Do renovation and installation of equipment in a religious building require a construction license in Vietnam?
Based on Article 16 of Decree 162/2017/ND-CP on renovation, upgrade and construction of folk religious buildings, religious buildings and auxiliary works, the following regulations apply:
1. Auxiliary works shall be renovated, upgraded and constructed as prescribed in Clauses 2 and 3 Article 58 of the Law.
2. When innovating or installing equipment in a folk religious building or religious building that is not a historical and cultural site/monument or scenic landscape ranked by a competent authority without changing its bearing structure or capacity and affecting environment and safety, the construction license is exempted.
According to Clause 2 and 3 of Article 58 of the Law on Religion and Folk Belief 2016, the following regulations apply to the overhaul, upgrade and construction of folk religious and religious buildings:
2. The overhaul, upgrade and construction of auxiliary facilities of a folk religious or religious establishment shall be subject to the legislation on construction applicable to the buildings and individual houses in urban areas, communal centers, conservation zones, sites of historic - cultural - revolutionary vestiges.
3. The repair and restoration of a folk religious or religious establishment that is a historic - cultural vestige or scenic sight ranked by competent government authorities, and the overhaul, upgrade and construction of the facilities auxiliary to such establishment shall be subject to the legislation on cultural heritage and on construction.
Therefore, for the renovation and installation of equipment in a religious building that fall under the above cases and do not affect the functional use, the environment, and the safety of the construction, a construction license is not required.

Does a dissolved religious educational institution have to be announced on mass media in Vietnam?
According to Article 14 of Decree 162/2017/ND-CP on the responsibility for publishing the dissolution of a religious organization, religious affiliate or religious educational institution through mass media, the following regulations apply:
1. 15 days after the date of dissolution, the dissolution of a religious organization, religious affiliate or religious educational institution shall be published on five issues of a printed newspaper or online newspaper of the central government or local government of the area where the base of such religious organization, religious affiliate or religious educational institution exists.
2. Each competent authority, religious organization and religious affiliate that has the right to carry out dissolution shall publish the dissolution as prescribed in Clause 1 of this Article.
Therefore, the dissolution of religious educational institutions must be publicly announced in three written newspapers or electronic newspapers at the central or local level where the religious educational institution is located, as prescribed above.
