Determining the Construction Grade According to Which Principles?

According to Article 2 of Circular 06/2021/TT-BXD (effective from August 15, 2021) regulating the principles for determining the grade of a construction work as follows:

1. The grade of a construction work stipulated in this Circular is determined based on the following criteria:

a) The degree of importance, scale of capacity: Applicable to each independent project or a complex of projects or a technological line consisting of multiple components under construction investment projects as per the types of construction works specified in Appendix I of this Circular;

b) Structural scale: Applicable to each independent project under construction investment projects according to the structural types specified in Appendix II of this Circular.

2. The grade of an independent construction is the highest grade determined according to Appendix I and Appendix II of this Circular. In case an independent construction is not specified in Appendix I of this Circular, the grade shall be determined according to the provisions of Appendix II of this Circular and vice versa.

3. The grade of a complex of constructions or a technological line consisting of multiple components is determined as follows:

a) In case the complex of constructions or the technological line consisting of multiple components is specified in Appendix I of this Circular, the grade shall be determined according to Appendix I of this Circular;

b) In case the complex of constructions or the technological line consisting of multiple components is not specified in Appendix I of this Circular, the grade shall be determined according to the grade of the main construction (belonging to the complex or technological line) with the highest grade. The grade of the main construction shall be determined according to the provisions of Clause 2 of this Article.

4. The grade of an existing construction that is repaired, renovated, or upgraded is determined as follows:

a) In case the repair, renovation, or upgrade changes the criteria for determining the grade of the construction prescribed in Clause 1 of this Article, the grade of the construction after repair, renovation, or upgrade shall be determined according to the provisions of this Article;

b) In cases other than those stipulated in Point a of this Clause, the grade of the construction before and after repair, renovation, or upgrade does not change.
