Pursuant to Article 5 of Circular 182/2019/TT-BQP stipulates procedures for visiting prisoners as follows:

1. Detention facilities issue visitation books to prisoners according to the uniform form issued by the criminal judgment execution management agency. The visit book is signed and sealed by the Head of the detention facility and must be confirmed by the Commune People's Committee or Commune Police where that person resides or the agency or organization where that person is working or studying confirms the list of relatives of the prisoner.

2. Relatives who visit the prisoner must be the person whose name is in the visit book; In case the first visit does not have a visit book or the individual's name is not in the visit book, there must be an application for a visit with confirmation from the Commune People's Committee or the commune-level police of the place of residence or the agency or organization where that person is working or studying.

3. Representatives of agencies and organizations specified in Clause 2, Article 4 of this Circular, when visiting prisoners, must send a written request to the detention facility to visit and meet prisoners. The official dispatch must clearly state the prisoner being visited, the person visiting, the reason for the visit, and the time of the visit.

4. When visiting, in addition to the application (for individuals) and official dispatch (for agencies and organizations), the visitor must bring one of the following documents: ID card; passport; Documents proving that you are an officer, soldier, or employee if you belong to the armed forces; In case the person visiting does not have identification papers, an application with a photo must be submitted by the Commune-level People's Committee or Commune-level Police of the place of residence or the agency or organization where that person is working or studying confirms, stamps the application and stamps the photo.

5. Relatives who are the wife (or husband) of the prisoner and are eligible to meet the prisoner in a private room according to the provisions of Clause 1, Article 52 of the Law on Execution of Criminal Judgments must have a copy of the marriage certificate or certificate of marital status from the commune-level People's Committee where the prisoner's spouse resides.

6. Procedures for visiting foreign prisoners comply with the provisions of Clause 5, Article 52 of the Law on Execution of Criminal Judgments.

Thus, relatives whose names are not in the visit book can still visit the prisoner if there is a request for a visit with confirmation from the Commune People's Committee or the Commune Police of the place of residence or the agency or organization where that person is working or studying.

According to Article 3 of Circular 182/2019/TT-BQP, regulations on meeting relatives are as follows:

1. Prisoners are allowed to meet their relatives according to the provisions of Clause 1, Article 52 of the Law on Execution of Criminal Judgments, except in cases where they are being disciplined as prescribed in Clause 2, Article 43 of the Law on Execution of Criminal Judgments; prisoners who are under 18 years old are allowed to meet their relatives according to the provisions of Article 76 of the Law on Execution of Criminal Judgments.

2. Prisoners comply well with the regulations of the detention facility, actively study, work, request education, reform or to exercise the rights and obligations of prisoners according to the provisions of law, the head of the facility shall The detention center may extend the visit time but not to exceed 3 hours or to see the spouse in a separate room for no more than 24 hours. prisoners who are rewarded or meritorious are allowed to meet their relatives one more time per month.

3. The head of the detention facility must organize for prisoners to meet their relatives on every day of the week, including holidays and New Year. The time for prisoners to meet their relatives during the day is decided by the head of the detention facility.

4. In the case of visits specified in Clause 2 of this Article or the prisoner has at least 04 months prior to the time of review being rated Good or due to the requirements of the education and reformation of prisoners, coordination is required, the impact of the family, the head of the detention facility can consider and decide to allow the prisoner to have meals with relatives at home to visit for no more than 60 minutes. The organization of meals for prisoners with their relatives must be strictly inspected and controlled, ensuring absolute safety.

According to this Article, when the head of a detention facility considers and decides to let an prisoner eat with his or her relatives, the meal time must not exceed 60 minutes in Vietnam.
