Can a Wedding Tent be Erected for 3 Days on the Sidewalk?
According to Clause 4, Article 1 of Decree 100/2013/ND-CP, the regulations are as follows:
The sidewalk can be temporarily used for purposes other than traffic in the following cases:
- Propaganda of the policies and guidelines of the Communist Party and the laws of the State. The temporary use of the sidewalk shall not exceed 30 days; in cases where the temporary use exceeds 30 days, approval must be obtained from the Ministry of Transport (for national highways) or the Provincial People's Committee (for local road systems);
- Organizing funerals and parking spaces for funeral services of households; the temporary use of the sidewalk shall not exceed 48 hours, and in special cases, it shall not exceed 72 hours;
- Organizing weddings and parking spaces to serve wedding services of households; the temporary use of the sidewalk shall not exceed 48 hours;
- Parking spaces to serve cultural, sports, parades, and festival activities; the temporary use of the sidewalk shall not exceed the duration of the cultural activities;
- Transfer points for construction materials and waste to serve the construction work of households; the usage time is from 10 PM of the previous day to 6 AM of the following day.
Thus, in the case of organizing a wedding, the temporary use of the sidewalk shall not exceed 48 hours. Comparing this to the case where your neighbor organizes a wedding and sets up a tent on the sidewalk for 3 days, it is not in compliance with the regulations.
Respectfully!
