Authority in Inspecting the Acceptance of Construction Works
According to Clause 2, Article 24 of Decree 06/2021/ND-CP regulating the inspection of construction project acceptance work, it is stated:
- Inspection Authority:
a) The council stipulated in Article 25 of this Decree conducts inspections for construction works specified in Point a, Clause 1 of this Article;
b) Professional construction agencies under the Ministry managing specialized construction works inspect various types of constructions regardless of investment capital sources, under the management of the ministry as stipulated in Clause 3, Article 52 of this Decree, including: Grade I constructions, special-grade constructions, constructions assigned by the Prime Minister, constructions along routes passing through two or more provinces; constructions of projects decided by central agencies of political organizations, the Supreme People's Procuracy, the Supreme People's Court, the State Audit, the Office of the President, the Office of the National Assembly, ministries, ministerial-level agencies, agencies under the Government, central agencies of the Vietnamese Fatherland Front, and socio-political organizations (hereinafter referred to as ministries, central agencies) invest or delegate, authorize investment decisions; constructions of projects decided to invest or led by state economic groups; excluding constructions specified in Point a of this Clause;
c) Professional construction agencies under the provincial People's Committee inspect various types of constructions within the locality's management responsibility as stipulated in Clause 4, Article 52 of this Decree, excluding constructions specified in Points a and b of this Clause; the provincial People's Committee may delegate the inspection of construction acceptance work to professional agencies under the district People's Committee;
d) The Minister of National Defense, the Minister of Public Security stipulate the inspection authority for constructions serving defense and security purposes;
dd) In cases where the construction investment project comprises numerous constructions and work items of different types and grades under the subjects stipulated in Clause 1 of this Article, the leading agency responsible for carrying out the inspection is the agency responsible for inspecting the main construction or work item of the highest grade in the construction investment project.
