Hello, I have a problem that needs to be answered. On November 4, I was arrested by the traffic police because I only had one mirror on the right side. The police did not make a record and told me to pay a fine of 100,000 VND. Can I ask if a motorbike with only one right mirror will be fined? Is it right that the police did not make a record when punishing me?

In Clause 1, Article 17 of Decree 100/2019/ND-CP amended by Point dd, Clause 36, Article 2 of Decree 123/2021/ND-CP, regulations on penalties imposed upon by operators of mopeds and motorcycles (including electric motorcycles) and the like violating regulations on roadworthiness of vehicles running on public roads as follows:
1. A fine ranging from VND 100,000 to VND 200,000 shall be imposed for:
a) Operating the vehicle without a horn, plate lamp, brake lamp, or a mirror on the left, or without a functional one;
c) Operating a vehicle without turn signals or without functional ones;
d) Using an inappropriate horn for the type of vehicle;
dd) Operating a vehicle without a sound or smoke suppression system or without one that meets environmental requirements with regard to exhaust and noise;
e) Operating a vehicle without a lamp with low beam and a high beam, or without a functional and conformable one;
g) Operating a vehicle without a brake system or without a functional and conformable one;
h) Operating a vehicle with an additional headlamp towards the back.
Thus, according to the regulations on motorbikes, when participating in traffic, if there is no mirror on the left or there is one but it is ineffective, it is a violation of the law in Vietnam.
If you ride a motorbike but only have a mirror on the right, you will be fined from 100,000 VND to 200,000 VND. The police will fine you 100,000 VND in accordance with the law in Vietnam.

Is it legal for traffic police when administrative sanction without record taking in case motorbikes without mirrors in Vietnam?
According to Article 56 of the Law on Handling of Administrative Violations 2012, regulations on administrative sanction without record taking are as follows:
1. Administrative sanction without record taking is applicable in cases of warning or fines of up to VND 250,000 for individuals, VND 500,000 for organizations and the persons with sanctioning competence must make decisions of administrative sanctions on the spot.
In case administrative sanctions are detected thanks to using technical, professional equipment, means, the record must be taken.
2. Decisions of administrative sanctions on the spot must be written clearly the information of date of decisions; full name, address of violators or name, address of violating organizations; acts of violations; venues of violations; evidences and details related to the violation settlement; full name, position of persons who make sanctioning decisions; articles, clauses of applicable legal documents. In case of fines, there must be the fine levels in the decisions.
Therefore, according to the above regulations in Vietnam, a fine of up to 250,000 VND will be imposed on individuals in cases of handling administrative violations without making records. The traffic police do not make a record when sanctioning your motorbike without mirror on the left, which is in accordance with the law in Vietnam.
What are conditions for special-use vehicles to join in traffic in Vietnam?
Pursuant to Article 57 of the 2008 Road Traffic Law, conditions for special-use vehicles to join in traffic are as follows:
1. Satisfying the following quality, technical safety and environmental protection criteria:
a/ Having an effective brake system;
b/ Having an effective steering system;
c/ Having lamps;
d/ Ensuring the operator’s visibility;
e/ Special-use parts must be fitted firmly at right positions, ensuring safety while traveling;
f/ Ensuring exhaust gas and noise according to environmental standards;
2. Having a registration paper and number plate granted by competent state agencies.
3. Operating within the prescribed area, ensuring safety for people, vehicles and road works while traveling.
4. The manufacture, assembly, modification, repair and import of special-use vehicles must comply with regulations on quality, technical safety and environmental protection.
5. The owners and operators of special-use vehicles shall maintain the technical safety conditions and have them inspected as prescribed for special-use vehicles in road traffic.
6. The Minister of Transport shall issue specific regulations on quality, technical safety and environmental protection, the grant and withdrawal of registration papers and number plates; determine a list of special-use vehicles subject to inspection and organize the inspection; the Minister of Defense and the Minister of Public Security shall stipulate and organize the grant and withdrawal of registration papers and number plates and the inspection of army and police special-use vehicles used for defense and security purposes.
Above are conditions for special-use vehicles to join in traffic in Vietnam.
