Which agency shall issue Vietnam postage stamps that are used for advance payment of charge of postal services in Vietnam?
Pursuant to Article 17 of the Decree 47/2011/NĐ-CP stipulating use of Vietnam postage stamps as follows:
1. The Vietnam postage stamps are used for advance payment of charge of postal services when meeting sufficiently the following conditions:
a) Being published by The Ministry of Information and Communications;
b) Not to be prohibited for circulation;
c) Not be stamped with a cancellation mark;
d) Still be intact.
2. The special postage stamps in time limit of supply, the common postage stamps must be sold on public postal network at the proper price printed on stamp face, except for case of postage stamps with cancellation mark.
3. The special postage stamps being expired for supply are still valid in order to use in advance payment for charge of postal services.
4. The withdrawal and treatment of special postage stamps expired for supply, shall be performed under provisions of the Ministry of Information and Communications.
5. The print of Vietnam postage stamps in publications must use postage stamps with “specimen” letter or postage stamps with cancellation mark, unless printing zoom in many times under shape of posters, placards.
As regulations above, Vietnam postage stamps being published by The Ministry of Information and Communications shall be used for advance payment of charge of postal services.
Use of other Vietnam postage stamps must follow prescribed requirements to avoid violations and peanalties.
What are the fines for using Vietnam postage stamps bearing cancellation marks?
Pursuant to Article 14 of the Decree 15/2020/NĐ-CP stipulating violations against regulations on postage stamps in Vietnam as follows:
1. A warning or a fine ranging from VND 600,000 to VND 1,000,000 shall be imposed for the commission of one of the following violations in postage prepayment:
a) Using Vietnam postage stamps bearing cancellation marks;
b) Using Vietnam postage stamps which are damaged.
2. A fine ranging from VND 1,000,000 to VND 3,000,000 shall be imposed for using Vietnam’s postage stamps which are prohibited.
3. A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for using foreign postage stamps to prepay postage on postal items sent domestically or from Vietnam to a foreign country.
4. A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for the commission of one of the following violations:
a) Trading, exchanging, exhibiting or disseminating postage stamps bearing contents, images, marks or signs in contravention of social ethics, fine traditions and customs of Vietnam;
b) Selling Vietnam postage stamps on public postal network within their supply period at prices other than those printed on stamps, excluding postage stamps bearing cancellation marks;
c) Selling special postage stamps of which the supply period expires on public postal network, except re-purchased stamps;
d) Selling Vietnam’s postage stamps without obtaining an issue decision from a competent authority;
dd) Organizing philatelic exhibitions inconsistently with regulations promulgated by competent authorities;
e) Failing to use Vietnam postage stamps bearing “specimen” word or cancellation marks when printing them on publications, unless a postage stamp is greatly magnified as a panel or poster;
g) Keeping Vietnam postage stamps and their design dossiers against law regulations.
5. A fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed for the commission of one of the following violations:
a) Trading, exchanging, exhibiting or disseminating foreign postage stamps whose contents and origin are not accepted as notified by postal service authorities of member states of the Universal Postal Union and stamp collectors associations;
b) Printing Vietnam postage stamps against the decision issued by a competent authority;
c) Failing to keep Vietnam’s postage stamps and their design dossiers.

Pursuant to Clause 3 Article 4 of the Decree 15/2020/NĐ-CP (amended by Clause 5.b and 5.c Article 1 of of the Decree 14/2022/NĐ-CP) stipulating fines and power to impose fines as follows:
3. The fines prescribed in Chapter II to Chapter VII hereof are imposed for administrative violations committed by organizations, except the administrative violations mentioned in Article 106 hereof. The fine imposed on an individual shall be half the one imposed on an organization for committing the same violation.
As regulations above, individuals using Vietnam postage stamps bearing cancellation marks shall be fined from VND 300,000 to VND 500,000. For organizations, they will be fined VND 600,000 to VND 1,00,000.
