What needs to be done to request a stay of execution of a financial penalty decision?
Based on Clause 2, Article 76 of the 2012 Law on Handling Administrative Violations, which stipulates as follows:
The decision to impose a fine may be postponed in cases where an individual subjected to a fine of 3,000,000 VND or more is experiencing exceptional, unexpected financial difficulties due to natural disasters, calamities, fires, epidemics, severe illnesses, accidents, and has confirmation from the commune-level People's Committee where the individual resides or the agency or organization where the individual studies or works.
The individual must submit an application for postponement of the enforcement of the administrative violation penalty decision to the authority that issued the penalty decision. Within 05 days from the date of receipt of the application, the authority that issued the penalty decision shall review and decide on the postponement of the enforcement of that penalty decision.
The period for postponement of the enforcement of the penalty decision shall not exceed 03 months from the date the postponement decision is issued.
Thus, in your case, you may submit an application for postponement of the enforcement of the administrative violation penalty decision to the authority that issued the penalty decision for their review.
