What is the penalty for buses adding extra seats?
Point e Clause 3 Article 16 of Decree 100/2019/ND-CP stipulates penalties for drivers of passenger cars (including trailers or semi-trailers being towed) and similar types of vehicles that violate regulations on vehicle conditions when participating in traffic as follows:
A fine ranging from VND 800,000 to VND 1,000,000 for one of the following violations:
Operating a passenger transport vehicle with additional or removed seats, sleeper berths, or having the luggage compartment size (vehicle cargo hold) not in accordance with the manufacturer's design or the design registered with the vehicle registration authority or the modified design approved by the competent authority.
In addition, Point b Clause 7 Article 16 of Decree 100/2019/ND-CP also stipulates: In addition to being fined, drivers committing the violation will also be subject to the following corrective measures:
Committing the acts stipulated at Point a, Point e Clause 3 of this Article must install full equipment or restore the technical features of the equipment as regulated, and remove any non-conformable added equipment.
Therefore, if you are a passenger car driver who adds seats, you will be fined between 800,000 and 1,000,000 VND. Additionally, you will also be required to remove the added seats.
