Article 53. Effective Implementation
- This Decree takes effect from January 1, 2025, except as provided in clause 2 of this Article.
- The regulations at point m clause 3 Article 6, point e clause 4 Article 26, point b clause 1 Article 27 of this Decree take effect from January 1, 2026; the regulation at point b clause 1 Article 32 of this Decree takes effect according to the provisions of environmental protection law on emissions inspection for motorcycles and motorbikes.
Traffic violations effective from January 1, 2026 in Vietnam include:
[1] Fines from VND 800,000 to VND 1,000,000: Transporting children under 10 years old and shorter than 1.35 meters in a car without using appropriate safety equipment for children as prescribed (except for cars with only one row of seats)
[2] Fines from VND 3,000,000 to VND 4,000,000 for individuals, from VND 6,000,000 to VND 8,000,000 for transport businesses, support services: Using commercial transport vehicles to transport preschool children and elementary students without suitable seatbelts or child seats as prescribed
[3] Fines from VND 1,000,000 to VND 2,000,000: Operating commercial transport vehicles for preschool children and elementary students without the appropriate seatbelts or child seats as prescribed

What is the statute of limitations for administrative penalties regarding order and traffic safety in the field of road traffic in Vietnam?
Based on Article 4 of Decree 168/2024/ND-CP on the statute of limitations for administrative violations and ongoing administrative violations:
Article 4. Statute of Limitations for Administrative Violations; Completed Administrative Violations, Ongoing Administrative Violations
- The statute of limitations for administrative penalties concerning traffic order and safety in the road traffic sector is 1 year.
- The period for using results collected by technical-professional means and equipment provided by individuals and organizations to determine violations is calculated from the time results are recorded until the last day of the statute of limitations for administrative violations pursuant to clause 1 Article 6 of the Law Handling Administrative Violations.
Beyond this time limit, if the competent authority does not issue a penalty decision, the results collected by technical means and equipment or provided by individuals and organizations lose their validity. If individuals or organizations deliberately evade or obstruct the penalty, the validity period of the results collected is recalculated from the time the evasion or obstruction ceases.

According to clause 3 Article 3 of Decree 168/2024/ND-CP, the remedial measures for administrative violations in traffic order and safety in the road traffic sector include:
- Restoring the original condition altered by administrative violations
- Implementing measures to rectify environmental pollution caused by administrative violations
- Mandatory re-export of vehicles from Vietnam
- Returning illicit profit gained from administrative violations
- Demolishing any obstruction to road signs and traffic signals
- Installing necessary equipment, replacing equipment with those meeting technical standards, or restoring vehicle and equipment features as required; removing non-conformable installed equipment
- Issuing driver identification cards to drivers as prescribed
- Conducting professional training, instruction of procedures, or organizing regular health checks for drivers and service staff on vehicles
- Installing journey monitoring devices, equipment to record the image of drivers, seatbelts, seats for preschool children, and elementary students, and specialized rescue tools and devices on vehicles conformable
- Removing sound and light equipment on vehicles that disrupt road traffic order and safety
- Providing, updating, transmitting, storing, and managing information data from the journey monitoring devices and equipment installed on vehicles
- Correcting incorrect odometer readings on falsified vehicles
- Restoring trademarks and paint colors recorded in vehicle registration certificates as required
- Conforming to regulations on vehicle number plates, labeling or marking letters, numbers, and information on vehicle bodies and doors, and conforming to paint colors and identification signs
- Restoring the original shape, size, and technical safety status of the vehicle, and testing before putting the vehicle into operation
- Adjusting the vehicle's cargo box to conformable standards, re-inspecting, and adjusting the permissible load noted in the technical safety and environmental protection inspection certificate before operational use
- Carrying out procedures for changing, revoking, reissuing vehicle registration certificates, number plates, and safety inspection certificates as required
- Surrendering fake or tampered practice licenses and certificates
- Returning vehicles to the Special Economic Trade Zone, International Border Gate Economic Zone
