Based on Clause 1, Article 14 of Decree 168/2024/ND-CP on penalties and point deductions from the driving licenses of operators of motorcycles, mopeds, and vehicles similar to motorcycles and mopeds for violating regulations on vehicle conditions when participating in traffic:

Article 14. Penalties and point deductions from the driving licenses of operators of motorcycles, mopeds, and vehicles similar to motorcycles and mopeds for violating regulations on vehicle conditions when participating in traffic

  1. A fine from 400,000 VND to 600,000 VND shall be imposed for the following violations:

a) Operating a vehicle without a horn; license plate light; brake light; left rearview mirror of the operator, or having one but it is not functional;

b) Operating a vehicle without a signal light or having one but it is not functional;

c) Operating a vehicle without near, far lights or having them but they are non-functional, not meeting design standards;

d) Operating a vehicle without a braking system or having one but it is non-functional, failing to ensure technical standards;

dd) Operating a vehicle equipped with rear-light projectors.

According to the above regulations, a motorcycle operator without a left rearview mirror or having one but it is non-functional shall be fined between 400,000 VND and 600,000 VND.

What are administrative sanctions and remedial measures in the field of road traffic in Vietnam?

Based on Article 3 of Decree 168/2024/ND-CP, the forms of administrative sanctions and remedial measures in the field of road traffic include:

- Warning

- Fine

- Confiscation of the means used for administrative violations

[2] Additional sanction forms

- Temporary revocation of the use of licenses, professional certificates

- Temporary suspension of activities

- Confiscation of violating items, means used for administrative violations in cases other than confiscation of means used for administrative violations

[3] Remedial measures

- Restore the original state that was changed due to administrative violations

- Implement measures to remedy environmental pollution caused by administrative violations

- Force re-export of vehicles from Vietnam

- Submit back illegal gains obtained from committing administrative violations

- Demolish items obstructing road signs, traffic signal lights

- Fully install or replace equipment meeting safety and technical standards or restore technical features of vehicles, equipment according to regulations or remove non-conformable additional equipment

- Issue driver identification cards according to regulations

- Organize training and guide the profession, procedures, or organize regular health checkups for drivers and service staff on vehicles as per regulations

- Install journey monitoring devices, image recording devices of drivers, seat belts, seats for preschool children, primary students, specialized rescue tools and equipment on vehicles as per conformable

- Remove audio, lighting equipment installed on vehicles causing disorder, road traffic safety

- Provide, update, transmit, store, manage information, data from journey monitoring devices, image recording devices of drivers installed on vehicles according to regulations

- Adjust the indicator on the odometer tampered with on vehicles

- Restore the brand, color specified in the vehicle registration certificate according to regulations

- Implement conformable license plates, regulations on inscribing or sticking letters, numbers, and information on the vehicle body, doors, regulations on paint color, and signal identification of the vehicle

- Restore the original shape, size, technical safety condition of the vehicle and re-inspect before putting the vehicle into traffic

- Adjust the vehicle trunk according to the current conformable, re-inspect and adjust the allowed cargo weight as stated in the Certificate of Vehicle Inspection and Environmental Protection according to current regulations before putting the vehicle into traffic

- Process procedures for change, withdrawal, re-issuance, issuance of vehicle registration certificates, vehicle plates, certificates of vehicle technical safety and environmental protection according to regulations

- Submit back altered, corrected, or content-distorted licenses, professional certificates

- Return vehicles to the Special Economic Trade Zone, International Border Gate Economic Zone

What are principles for road traffic order and safety in Vietnam?

Based on Article 3 of the Law on Road Traffic Order and Safety 2024, the principles for road traffic order and safety in Vietnam are as follows:

- Comply with the Constitution, Vietnamese law, and international treaties to which the Socialist Republic of Vietnam is a member.

- Ensure road traffic is orderly, safe, and smooth, contributing to socio-economic development, national defense, security, and environmental protection; prevent legal violations concerning road traffic order and safety, road traffic accidents, and traffic congestion; protect life, health, and property of individuals and agencies, organizations.

- Ensuring road traffic order and safety is the responsibility of agencies, organizations, and individuals.

- Road users must comply with legal regulations on road traffic order and safety and other related legal provisions, being responsible for their own and others' safety.

- All violations of the law on road traffic order and safety must be detected and promptly prevented and subject to strict legal penalties.

- Activities to ensure road traffic order and safety must be public, transparent, and convenient for the people.

- The work of ensuring road traffic order and safety is implemented uniformly based on assignment, decentralization, suitable to the functions and duties, with strict coordination between related agencies, organizations, and individuals.
