What are the penalties for carrying passengers by cargo vehicles in Vietnam?
Pursuant to Clause 2 Article 24 of the Decree 100/2019/NĐ-CP, a fine ranging from VND 800,000 to VND 1,000,000 shall be imposed for:
- Operating a vehicle (including trailers and semi-trailers) carrying cargo beyond the maximum permissible payload written in the Certificate of technical and environmental safety by exceeding 10% to 30% (for vehicles other than tanker trucks) or by exceeding 20% to 30% (for tanker trucks);
- Putting cargo on the roof; stacking cargo beyond the width of the cargo container; stacking goods longer than the length of the vehicle by more than 10%;
- Carrying passengers in the cargo container; allowing the passenger to sit or lie on the roof or hang from the vehicle while it is running;

As regulations above, a fine ranging from VND 800,000 to VND 1,000,000 shall be imposed for carrying passengers in the cargo container; allowing the passenger to sit or lie on the roof or hang from the vehicle while it is running. In addition, your drive license shall be revoked from 1 to 3 months.
In which cases shall cargo vehicles be permissible to carry passengers in Vietnam?
Pursuant to Article 21 of the Law on Road Traffic in 2008 stipulating cases in which cargo vehicles are permissible to carry passengers in Vietnam as follows:
- Persons may only be carried on cargo vehicles in the following cases:
+ Carrying persons to perform natural disaster prevention and combat tasks or urgent tasks; carrying people’s armed force officers and soldiers to perform their duties; carrying victims to hospital;
+ Carrying road maintenance and repair workers; carrying learner drivers on driving practice cars; carrying persons forming a procession;
+ Evacuating persons out of dangerous areas or in other cases of emergency as prescribed by law.
- Vehicles carrying persons in the cases specified in Clause 1 of this Article must have a fixed trunk, ensuring traffic safety.
