What are regulations on responsibility of the agency, unit receiving, collecting data obtained from technical mean, equipment in Vietnam?

Based on Article 19 of Decree 135/2021/ND-CP regulating the responsibilities of the agency, unit receiving, collecting data obtained from technical means, equipment as follows:

1. Publicly disclose the address of the headquarters of the agency, unit, postal address, email, electronic information portal or website, hotline number of the agency, unit to individuals, organizations providing information, data.

2. Arrange personnel to receive, collect data.

3. Ensure the confidentiality of personal information, information provided by individuals, organizations as regulated in point b clause 2 of this Decree and individuals, related organizations to the data obtained from technical means, equipment.

4. Send notification of verification results, data processing to individuals, organizations that have provided if those individuals, organizations request.

What are regulations on receiving, collecting, and processing data obtained from technical mean, equipment in Vietnam?

According to Article 20 of Decree 135/2021/ND-CP regulating the receiving, collecting, and processing data obtained from technical mean, equipment is regulated as follows:

1. Receiving, collecting data from the following sources:

a) Data transferred by competent state agencies for inspection, verification;

b) Data posted on public information media;

c) Data provided by individuals, organizations as regulated in clause 1 of Article 16.

2. Procedures for receiving, collecting data:

a) Guide individuals, organizations to provide data according to the regulations of this Decree;

b) Carry out the reception, collection of data from the sources specified in this clause.

In cases where data obtained from technical means, equipment is provided without clear names, addresses of individuals, organizations providing data but with specific evidence of violations and a basis for verification, verification, processing shall be carried out by the competent agency, unit, person, in accordance with regulations;

c) Record in the logbook and report on the reception, collection of data.

The received, collected data must be recorded in the logbook or monitoring software and reported promptly to the authorized person for resolution, processing according to regulations.

3. Processing of received, collected data:

The agency, unit of the authorized person to handle administrative violations processes the received, collected data as follows:

a) Data under the jurisdiction of processing shall proceed with verification procedures according to the regulations of Article 21 of this Decree;

b) Data not under the jurisdiction of processing shall be transferred to the competent agency, unit to carry out verification;

c) Results obtained from technical means, equipment as regulated in Article 22 of this Decree do not require verification; processing shall be carried out according to the regulations of Article 15 of this Decree.
