What are penaties for a motorcycle overtaking on the right in Vietnam?
Based on Point d Clause 3; Point a Clause 10; Point d Clause 13, Article 7 of Decree 168/2024/ND-CP on sanctions and point deductions on the driver license of operators of motorcycles, mopeds, vehicles similar to motorcycles, and vehicles similar to mopeds that violate road traffic rules:
Article 7. Sanctions and Point Deductions on the Driver License of Operators of Motorcycles, Mopeds, Vehicles Similar to Motorcycles, and Vehicles Similar to Mopeds that Violate Road Traffic Rules

- A fine ranging from 600,000 VND to 800,000 VND shall be imposed on operators who commit one of the following violations:

d) Overtaking on the right in cases where it is not permitted;

- A fine ranging from 10,000,000 VND to 14,000,000 VND shall be imposed on operators who commit one of the following violations:
a) Operating the vehicle without observation, slowing down, or stopping to ensure safety as prescribed, causing a traffic accident; operating the vehicle exceeding the prescribed speed causing a traffic accident; entering a highway, stopping, parking, turning around, reversing, overtaking, changing direction, or lane improperly causing a traffic accident; not keeping the correct lane, not maintaining a safe distance between vehicles as prescribed causing a traffic accident, or entering a road that is signposted as prohibited for the type of vehicle being driven, going against the one-way street direction, going against the “No Entry” sign causing a traffic accident;

- In addition to the penalties imposed, operators committing violations shall also have points deducted from their driver license as follows:

d) Committing the actions specified in Point b of Clause 8, Clause 10 of this Article results in having 10 points deducted from the driver license.
According to the above regulations, a motorcycle operator overtaking on the right in cases where it is not permitted will be fined between 600,000 VND and 800,000 VND.
In cases where a motorcycle operator overtakes on the right in an unauthorized manner causing a traffic accident, they will be fined from 10,000,000 VND to 14,000,000 VND and will have 10 points deducted from their driver license.

When is it permissible for a motorcycle operator in Vietnam to overtake on the right?
Based on Article 14 of the Road Traffic Safety Law 2024 on overtaking and yielding for overtaking vehicles:
Article 14. Overtaking and Yielding to Overtaking Vehicles
- Overtaking is a traffic scenario on roads where each driving direction has only one lane for motor vehicles, and a vehicle moves to the left to pass a vehicle ahead.
On roads with two or more lanes for the same direction marked by lane dividers, the vehicle behind overtakes the front vehicle according to the lane use rules stipulated in Article 13 of this Law.
- Vehicles must overtake on the left; in cases where the vehicle ahead signals a left turn or is turning left, or when special vehicles are working on the road making overtaking on the left impossible, they may overtake on the right.
- A vehicle requesting to overtake may only do so when there are no obstacles ahead, no vehicles traveling in the opposite direction on the intended overtaking stretch, the vehicle in front shows no signal of overtaking another vehicle, and when it has signaled a right turn and moved to the right.

According to these regulations, a motorcycle operator is allowed to overtake on the right in the following situations:
- When the vehicle in front signals a left turn
- When the vehicle in front is turning left
- When special vehicles are working on the road making overtaking on the left impossible
What are the additional sanctions in administrative penalties for road traffic safety in Vietnam?
According to Clause 2, Article 3 of Decree 168/2024/ND-CP, based on the nature and severity of the violation, individuals or organizations that commit administrative violations in road traffic order and safety may be subject to one or more additional penalties, including:
- Revocation of licenses or certificates of professional practice for a certain period
- Suspension of operations for a certain period
- Confiscation of administrative violation instruments or vehicles used to commit administrative violations in cases where confiscation is not applied as a principal penalty
