Based on Point a, Clause 3, Article 6 of Decree 168/2024/ND-CP on penalties and the deduction of driving points for operators of automobiles, four-wheeled motor vehicles, four-wheeled freight vehicles, and similar vehicles violating road traffic regulations:

Article 6. Penalizing and deducting driving points for operators of automobiles, four-wheeled motor vehicles, four-wheeled freight vehicles, and similar vehicles violating road traffic regulations

  1. A fine ranging from 800,000 VND to 1,000,000 VND shall be imposed on operators committing any of the following violations:

a) Operating a vehicle exceeding the regulated speed by 05 km/h to less than 10 km/h;

Based on Article 42 of Decree 168/2024/ND-CP on the penalizing authority of Chairmen of People's Committees at all levels:

Article 42. Penalizing authority of Chairmen of People's Committees at all levels

[...]

  1. The Chairman of the Provincial People's Committee has the authority to:

a) Issue warnings;

b) Impose fines up to 75,000,000 VND;

c) Revoke licenses or permits temporarily or suspend operations temporarily;

d) Confiscate means or materials used for administrative violations;

dd) Apply remedial measures stipulated in Clause 3, Article 3 of this Decree.

According to the above regulation, the chairman of the Provincial People's Committee has the authority to impose fines for traffic violations up to 75,000,000 VND.

What acts are prohibited in road traffic safety in Vietnam?

Based on Article 9 of the Road Traffic Safety and Order Law 2024, prohibited acts in road traffic safety and order include:

- Driving motor vehicles on roadways without a license according to the law; operating special-use motorcycles on roadways without a license or a certificate of legal knowledge about road traffic, an operation license, or a certificate for special-use motorcycles.

- Operating vehicles on roadways while having alcohol content in blood or breath.

- Operating vehicles on roadways while having drugs or other substances banned by law.

- Insulting, threatening, obstructing, resisting, or not complying with the orders, guidance, inspection, and control requests of officials tasked with maintaining road traffic order and safety.

- Illegal racing, organizing races, inciting, abetting, encouraging illegal racing; driving vehicles on roadways with reckless behavior or continuous revving.

- Handholding and using a phone or other electronic devices while driving vehicles on roadways.

- Entrusting motor vehicles or special-use motorcycles to individuals not qualified by law to drive on roadways.

- Putting motor vehicles or special-use motorcycles that do not meet technical and environmental safety laws, or other vehicles not in accordance with the law, into traffic on roadways.

- Importing, manufacturing, assembling motor vehicles, and special-use motorcycles not meeting legal requirements for technical safety and environmental protection.

- Illegally modifying other types of automobiles into passenger cars, except for conversion into vehicles for defense and security purposes.

- Illegal modifications, intentionally falsifying odometer readings on automobiles; cutting, welding, erasing, chiseling, or illicitly altering the chassis number or engine number of motor vehicles and special-use motorcycles.

- Deliberately tampering with or changing the software of a vehicle or engine registered with the governing authority to cheat testing results; renting or borrowing motor vehicle parts only for inspection purposes.

- Transporting goods exceeding the vehicle's total weight, axle load, or dimensional limits or exceeding road limits without a permit or necessary measures as per the law; carrying goods that require securing without properly securing or improperly securing as prescribed by law; carrying more passengers than legally permitted.

- Transporting prohibited goods, illegal transport or failing to comply with complete legal requirements for transporting hazardous goods or wild animals.

- Threatening, insulting, competing for passengers; forcing, coercing passengers to use services against their will; illegally unloading passengers or other acts to evade detection of vehicle overload or carrying too many passengers.

- Installing or using audio or lighting equipment on motor vehicles or special-use motorcycles causing disturbances to road traffic safety and order.

- Producing, using, illegally buying or selling vehicle license plates; operating motor vehicles or special-use motorcycles with plates not issued by a competent state agency, improperly affixing plates; bending, covering, or altering plates; modifying the letters, numbers, colors, and shapes of the plates.

- Interrupting or altering data of journey monitoring devices, cameras installed in vehicles according to this law.

- Destroying, damaging, or disabling road traffic control devices or intelligent traffic management systems.

- Illegally placing or leaving obstacles on roadways; scattering sharp objects, pouring slippery substances on roadways; spilling soil, goods, construction materials, waste on roadways; dumping chemicals or waste causing road traffic safety issues.

- Obstructing people or vehicles on roadways; throwing bricks, soil, stones, sand, or other objects at people or vehicles on roadways.

- Exploiting or abusing road traffic order and safety maintenance duties to violate laws, harass, or infringe on state interests, and the legitimate rights and interests of organizations or individuals.

- Abusing positions, powers, professional responsibilities, or those of others to violate road traffic safety and order laws or interfering in the handling of road traffic safety and order violations.

- Misusing priority vehicle rights when not performing tasks as prescribed by law; installing or using unauthorized priority signal devices.

- Failing to report, falsely reporting, or providing false information to evade responsibility when detected violating road traffic safety and order laws.

- Fleeing after causing road traffic accidents to evade responsibility; deliberately not helping road accident victims when conditions allow; infringing the life, health, property of victims, offenders, or those helping, rescuing, taking victims to emergency; exploiting road traffic accidents to assault, threaten, incite, pressure, disrupt, or obstruct traffic accident handling.

- Operating drones, unmanned aircraft, or ultra-light aircraft within roadway limits causing obstruction or endangering road traffic participants' safety, except for drones and ultra-light vehicles with a flight permit.

- Other actions violating road traffic rules
