What are fines for acts of appropriating relief in Vietnam?
Based on Article 14 of Decree 03/2022/ND-CP stipulating penalties for violations against regulations on disaster recovery:
Article 14. Violations against regulations on disaster recovery
1. A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for intentionally making false declarations or reports about damages caused by natural disasters.
2. A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for one of the following acts:
a) Misuse or loss of funds or relief supplies, providing relief to the wrong targets that do not reach the level of criminal liability;
b) Appropriating relief, which is not so serious that criminal prosecution may be brought;
c) Failing to promptly perform relief duties.
3. Remedial measures:
a) Forcing the return of illegal gains obtained from administrative violations stipulated in Clause 1 of this Article;
b) Forcing the continued performance of relief activities due to violations stipulated in Clause 2 of this Article.
According to the above regulation, anyone who misappropriates relief supplies that do not reach the level of criminal liability shall be fined from VND 5,000,000 to VND 10,000,000 and forced to return illegal gains obtained from the violation, as well as continuing to perform relief activities.
Note: The above fines apply to individuals. Organizations with the same violation will be fined double the amount applicable to individuals (stipulated in Clause 2, Article 6 of Decree 03/2022/ND-CP)

What are prohibited acts in natural disaster prevention and control in Vietnam?
Based on Article 12 of the Law on Natural Disaster Prevention and Control 2013, the following acts are prohibited in disaster prevention and control:
- Exploiting natural disasters and disaster prevention activities to harm national independence, sovereignty, unity, territorial integrity, national defense, security, and other national interests; causing social disorders; infringing on state and people's property, legal rights, and interests of organizations, individuals, communities, and conducting other illegal activities.
- Sabotaging, damaging, or obstructing the operation of disaster prevention works.
- Operating irrigation, hydropower reservoirs, sluice gates, and pumping stations not in accordance with approved procedures, except in special cases directed by authorized personnel.
- Engaging in activities that increase disaster risks without taking remedial measures, especially deforestation, encroaching on riverbanks and beds, creating obstacles, disrupting water flow, illegal sand, gravel, and mineral extraction causing river or coastal erosion.
- Resisting, obstructing, intentionally delaying, or not following disaster prevention and control directives of authorized agencies or personnel.
- Resisting, obstructing, or not following decisions to mobilize manpower, materials, vehicles, equipment, and essential goods for emergency disaster response by authorized agencies or personnel.
- Taking advantage of disasters to hoard and inflate prices of goods, materials, vehicles, equipment, and essential goods for profiteering, causing harm to people's livelihoods.
- Misusing, embezzling, or causing loss of funds and relief supplies; providing relief not promptly or not to the right targets.
- Intentionally spreading false information about disasters and disaster prevention activities.
- Intentionally making false reports about damages caused by natural disasters.
Forms of voluntary contributions for natural disaster prevention and control in Vietnam
Based on Article 11 of the Law on Natural Disaster Prevention and Control 2013 stipulating sources of voluntary contributions for natural disaster prevention and control:
Article 11. Sources of voluntary contributions for disaster prevention and control
- Voluntary contributions of organizations and individuals for disaster prevention and control can be in the forms of: contributing to social funds, charitable funds; participating in fundraising according to the law, and providing direct support to organizations, households, and individuals affected by natural disasters.
- The allocation and use of voluntary contributions stipulated in Clause 1 of this Article are to be implemented according to the law on social funds, charitable funds, and with the consensus of local authorities where the beneficiaries are supported.
Thus, voluntary contributions by individuals for disaster prevention and control can be in the following forms:
- Contributing to social funds, charitable funds
- Participating in fundraising according to the law and providing direct support to organizations, households, and individuals affected by natural disasters
