Violations Regarding Capacity Conditions for Water Resource Planning Consultancy: How Are They Handled?
Based on Article 6 of Decree 36/2020/ND-CP (effective May 10, 2020), which stipulates violations of regulations on competency conditions to implement basic investigation projects and plans for water resource planning, the following penalties will be applied:
A warning or a fine ranging from 100,000 VND to 500,000 VND for the act of providing insufficient notification content as required after being selected to implement a basic investigation project or water resource planning consultancy project.
A fine ranging from 3,000,000 VND to 5,000,000 VND for the act of failing to notify the competent state authority as required after being selected to implement a basic investigation project or water resource planning consultancy project.
A fine ranging from 20,000,000 VND to 30,000,000 VND for the act of the technical manager of a basic water resource investigation project or water resource planning consultancy project undertaking more than 3 basic water resource investigation projects or 4 or more water resource planning projects concurrently.
A fine ranging from 30,000,000 VND to 40,000,000 VND for the act of falsely declaring information in the competency profile for project establishment or reports during the implementation of basic investigation projects and water resource planning consultancy projects.
Supplementary penalty: Suspension of activities related to the implementation of the basic investigation project or water resource planning consultancy project for a period ranging from 1 month to 6 months for violations specified in Clause 4 of this Article.
