Vietnam: What is camera violation?
Currently, Vietnamese traffic laws do not define the term "camera violation." "camera violation" is a common term used to refer to traffic penalty methods via imagery in Vietnam.
Clause 11 of Article 80 of Decree 100/2019/ND-CP stipulates:
Persons entitled to impose penalties may utilize information and images recorded by sound and image recording devices provided by individuals and organizations to verify and detect the violations specified in this Decree.
The Minister of Public Security off Vietnam shall provide procedures for converting results collected from methods and devices other than professional methods and devices handed over by individuals and organizations into evidence to determine administrative violations in road and railway transport.
Additionally, according to Clause 1 of Article 24 of Circular 65/2020/TT-BCA, traffic police officers in Vietnam are also authorized to impose fines against violations against the regulations on road traffic order and safety based on information and images. This Circular identifies the sources from which information and images reflecting violations against the regulations on road traffic order and safety are received as follows:
- Be recorded using technical devices of organizations or individuals;
- Be published in mass media, social networks.
