Use of Electricity for Fishing in Border Rivers – What Are the Penalties?
According to Point c Clause 7 Article 6 of Decree 96/2020/ND-CP (effective from October 10, 2020) stipulates:
"7. A fine from 10,000,000 VND to 20,000,000 VND for one of the following acts:
…
c) Illegal fishing, using explosives, toxic chemicals, electric shocks on rivers and streams, and underground areas in border regions."
According to this regulation, the use of electric shocks for illegal fishing (catching fish) will be fined from 10,000,000 VND to 20,000,000 VND depending on the extent of the violation.
In addition, the offending materials and means (boats, fishing gear, electricity, etc.) will also be confiscated, goods (possibly the caught fish) will be destroyed, and the violator will be responsible for the costs to restore the original state (According to Point a Clause 11 and Point b Clause 12 of this Article).
Note: The above penalty applies to individuals. In case an organization commits the same violation as an individual, the fine will be twice the fine for an individual.
