Urban Trees Showing Signs of Uprooting, Falling into Houses: Are Residents Allowed to Self-Relocate?
According to Clause 3, Article 7 of Decree 64/2010/ND-CP, it is strictly prohibited to: Arbitrarily cut down, move, cut branches, prune branches, uproot, or cut the roots of green trees without permission.
And Clause 4, Article 53 of Decree 139/2017/ND-CP stipulates the penalties as follows:
A fine ranging from 20,000,000 VND to 30,000,000 VND shall be imposed on acts of arbitrarily cutting down, relocating, burning the roots, or uprooting of urban green trees, or improperly cutting the roots of green trees.
=> According to the above regulations, even if the green tree shows signs of tipping over and falling into the house, you are not allowed to arbitrarily move the tree to another location. In this case, you can report the situation to the urban management board, the head of the neighborhood group, or the ward chairman for assistance in resolving the issue.
