Unlawful Possession of Films Banned from Distribution: How Are Violations Penalized?

Point b Clause 5 Article 9 of Decree 38/2021/ND-CP stipulates:

A fine ranging from 25,000,000 VND to 30,000,000 VND for the act of illegal storage but not to the extent of being prosecuted for criminal liability for films that have been decided to be recalled, confiscated, destroyed, or banned from dissemination.

Thus, the act of illegal storage but not to the extent of being prosecuted for criminal liability for films that have been decided to be banned from dissemination will be fined from 25,000,000 VND to 30,000,000 VND.

Note, this penalty applies to individual violators; in case of organizational violations, the penalty will be doubled (Clause 2 Article 5 of this Decree).

Simultaneously, it is mandatory to destroy cultural products with harmful content; to remove cultural products with harmful content in electronic form, on cyberspace and digital technology (Point b, c Clause 7 Article 9 of this Decree).
