Trading Outside the Licensed Scope: Penalties and Regulations
According to Point a, Clause 4, Article 7 of Decree 96/2020/ND-CP (effective from October 10, 2020), the regulation is as follows:
"4. A fine ranging from 3,000,000 VND to 5,000,000 VND shall be imposed for one of the following acts:
a) Performing service or commercial activities in the border gate area without the authorization of the competent authority or conducting activities that do not match the fields specified in the license;
…”
Thus, according to this regulation, it is not permissible to engage in commercial activities (trading) that differ from (do not align with) the fields specified in the license. Violating this will result in a fine ranging from 3,000,000 to 5,000,000 VND depending on the severity. This fine applies to individuals. In the case of organizations committing the same violations as individuals, the fine amount will be double that imposed on individuals.
Additionally, there will be a revocation of the right to use the commercial activity license (business license, goods trading license) at the land border checkpoint for a period ranging from 03 months to 06 months (According to the regulation at Point b, Clause 7 of this Article).
