Title: What is the Penalty for Faking a Lost Driver's License to Get a Replacement After it is Confiscated?
Point b Clause 19 Article 1 of Circular 38/2019/TT-BGTVT stipulates as follows:
- Individuals who erase or alter information on the driver's license; use a fake driver's license or a fake driving permit record; use a driver's license that has been reported lost to operate a motor vehicle on the road; commit any other fraudulent acts to renew, reissue, or issue a new driver's license, the driver's license in question shall be null and void, in addition to being subject to a revocation decision by the driver's license management authority. The original records and updated management data on the driver's license system must also bear responsibility before the law and shall not be issued a driver's license within 05 years, from the date of discovery of the violation, they must undergo the training and testing process as if applying for a new driver's license for the first time.
=> Therefore, falsely reporting a lost driver's license that has already been revoked to be re-issued constitutes a fraudulent act, rendering the driver's license unusable. This is a violation of legal regulations regarding driving training and examination.
Point g Clause 3 Article 37 of Decree 100/2019/ND-CP is as follows:
"Fines ranging from 3,000,000 VND to 5,000,000 VND for any of the following violations:...g) Individuals who make false declarations or use fake documents or materials to learn, test, or renew, reissue a Driver's License or a certificate of legal knowledge on road traffic...."
=> Therefore, falsely reporting a lost driver's license that has already been revoked to be re-issued shall incur a fine ranging from 3,000,000 VND to 5,000,000 VND.
