Title: Can Motorbikes Be Temporarily Impounded for Entering Highways?
Point b Clause 6 Article 6 Decree 100/2019/ND-CP stipulates the penalties for operators of motorcycles and motorbikes (including electric motorbikes) who violate the road traffic rules as follows:
A fine ranging from VND 2,000,000 to VND 3,000,000 shall be imposed on the operator of the vehicle committing the following violation: Operating the vehicle on a highway, except for vehicles intended for the management and maintenance of the highway.
Meanwhile, Point b Clause 1 Article 82 Decree 100/2019/ND-CP stipulates regarding the temporary detention of vehicles as follows:
To immediately prevent administrative violations, the competent authority for fines may temporarily detain the vehicle for up to 07 days before making a penalty decision for the violations stipulated in the following articles, clauses, and points of this Decree, and must comply with Clause 2 Article 125 of the Law on Handling Administrative Violations:
Point b, point c clause 6; point c clause 7; point a, point b, point c, point d, point e, point g, point h, point i clause 8; clause 9 Article 6.
Thus, according to the above regulations, operating a motorcycle on a highway will result in a fine ranging from VND 2 million to VND 3 million and the vehicle being temporarily detained for up to 07 days before a penalty decision is made.
